On October 9th, Partner Randall Fox participated in a panel discussion of government personnel changes at The Anti-Fraud Coalition’s 26th Annual Conference. Kirby McInerney has been named Lead Counsel in a securities class action against Embecta Corp. a medical technology company specializing in diabetes management and insulin delivery devices.

The suit alleges that Embecta misled investors concerning the market strength of its insulin pen and pen needle products and downplayed significant customer losses and broader market softness, issuing guidance that was not achievable.

On May 5, 2026, Embecta revealed that its second-quarter revenue had dropped over 14% YOY and lowered full-year revenue projections, triggering a single day stock decline of nearly 58%.

We are pleased to announce that Judge William Shubb has granted final approval to the $303 million settlement of a wage-fixing class action Kirby McInerney and our co-counsel Gustafson Gluek PLLC and Fairmark Partners LLP brought on behalf of Division I volunteer coaches against the NCAA. On May 7, 2026, Randall Fox testified before the Pennsylvania House Democratic Policy Committee in support of House Bill 1697, the “Taxpayer Prevention Against Fraud Act,” legislation that would establish a Pennsylvania False Claims Act designed to combat frauds committed against state and local governments with the help of whistleblowers incentivized to come forward with concrete evidence of violations.
