When emotions run high during divorce and custody disputes, mediation can offer a more constructive path forward – but the experience of the mediator matters.

An experienced litigator serving as a mediator brings more than negotiation skills to the table. They bring perspective. By understanding both mediation and courtroom litigation, they can help parties make informed decisions, avoid unnecessary conflict, and recognize the long-term emotional and financial costs of abandoning the mediation process.

Mediation empowers individuals to maintain greater control over the outcome of their case, rather than leaving deeply personal decisions in the hands of the court. With the right guidance, even difficult conversations can lead to meaningful resolutions.

Fredrick D’Arcangelo, a partner and Co-Chair of the firm’s Divorce & Family Law group, explores why litigation experience can be a valuable asset in helping families reach amicable, practical resolutions – especially when children and future relationships are involved. When a Guardian Ad Litem (GAL) is appointed in a custody matter, it often signals that the court is seeking a clearer, more complete understanding of the child’s circumstances beyond what is presented in filings.

In New Jersey, a GAL does not determine custody. However, their evaluation can play a meaningful role in shaping how the court views a child’s needs, the home environment, and what a practical parenting plan looks like.

GALs provide a structured, child-centered perspective by assessing family dynamics and gathering input from key sources, including schools, medical providers, and other relevant professionals – particularly in high-conflict or complex cases.

A well-managed GAL process can bring clarity, reduce conflict, and lead to more durable outcomes for families.

If a GAL may be appointed in your case, understanding the process early can make a meaningful difference.

Nicole Kobis, a partner in the firm’s Divorce & Family Law group, shares her insights on how a Guardian Ad Litem can impact child custody and divorce proceedings in New Jersey.
