Does Florida protect your paycheck from garnishment?

Potentially.

Florida has a specific exemption for qualifying “head of family” earnings. The law currently protects disposable earnings of $750 per week or less for a qualifying head of family, and additional protections may apply to earnings above that amount depending on whether a valid waiver exists.

You opened your banking app and your available balance is suddenly $0.

A bank account garnishment can happen quickly once the legal process reaches that stage. But a frozen account does not automatically mean every dollar in it can legally be taken.

Florida law protects certain types of funds and income in qualifying circumstances. The source of the money in the account can matter.

Do not assume a bank freeze is the end of the story.

A debt collector calling at 10:00 p.m. is not something you necessarily have to tolerate.

Florida law generally prohibits communications to collect a consumer debt between 9:00 p.m. and 8:00 a.m. in the debtor’s time zone without prior consent, subject to specific exceptions.

In Florida, a defendant generally has 20 days after service of the complaint and summons to respond. Ignoring the lawsuit does not make the debt disappear. It can allow the creditor to pursue a default judgment.
