A recent case in New Jersey establishes that a prior conviction for refusing to give a breath sample after being stopped for suspected DWI is treated as a prior DWI conviction when considered after a subsequent offense. New legislation requires that certain New Jersey offenders have a breath monitoring devise installed in their vehicle after their FIRST DWI.

Paul R. Cohen was recently appointed Solicitor of Newtown Borough, in Bucks County. This appointment expands our municipal practice, which already includes representation of Pendell Borough, Upper Southampton Township & the Upper Southampton Sewer Authority. Colin Jenei currently serves as acting Solicitor for the Bucks County Department of Mental Health and Mental Retardation.

CONGRESS FAILS TO RESOLVE FEDERAL ESTATE TAX LIMBO. It looks more likely now that the Estate Tax will actually be repealed on January 1, 2010. Without further action, it will come back with a vengeance in 2011. While few large estates will benefit from the repeal, all estate beneficiaries will be paying higher taxes on capital gains, due to the (temporary) loss of the basis step up.

The federal estate tax will likely expire as scheduled Jan. 1, as Senate Democratic leaders failed in a last-ditch effort to pass an extension.

The Bucks County Court of Common Pleas reversed the Bucks County Board of Assessment Appeals and granted an exemption from Real Estate taxes to Paul R. Cohen's client. The decision will save the non-profit client over $25,000 a year in taxes.

If you are married and do not have a Will, do not assume that your spouse will get everything when you die. While your spouse will receive all joint assets "by operation of law," the assets titled in your name alone may be divided between your spouse and your children. If your children are minors, this may require the Court's involvement to protect the children's assets - making those assets inaccesible to your spouse.
