We often serve clients that are navigating the first steps after being served with a lawsuit. Their question is almost always: What should they do next?

First, don’t ignore it.

When you’re served with a Summons and Complaint, the clock starts ticking. Missing deadlines can result in a default judgment being entered against you, even if you have a valid defense.

Here are a few important steps:

• Read the documents carefully and note any deadlines.
• Preserve all records, emails, contracts, text messages, and other documents related to the dispute.
• Respond to any document demands or discovery requests on time.
• Appear for all scheduled court conferences and hearings.
• Avoid discussing the case publicly or on social media.
• Speak with an attorney as soon as possible to understand your rights and options.

Many people make the mistake of waiting until the last minute. Early legal guidance can help you avoid costly mistakes, protect important evidence, and position your case for the best possible outcome.

At Vilella Law, we help individuals and businesses navigate lawsuits from start to finish. Whether you’ve been sued, received document demands, need representation in court, or want to explore settlement options, we can guide you through the process and advocate for your interests every step of the way.

If you’ve been served with a lawsuit, don’t wait.

5 Legal Pitfalls New Business Owners Overlook

Starting a business means moving fast. Legal issues usually show up later.

Here are a few we see more often than you’d expect:

1. Signing personal guarantees without realizing it
Many agreements quietly tie your personal assets to business obligations.

2. Using handshake deals instead of clear agreements
Things work… until they don’t. Then there’s nothing to fall back on.

3. Not separating ownership and decision-making
Partnerships often start informally, which becomes a problem when roles or expectations shift.

4. Overlooking what happens if someone wants out
No plan for an exit usually means a complicated one later.

5. Assuming templates are “good enough”
Generic documents rarely reflect how your business actually operates.

Most of these aren’t complicated issues. They’re just easy to miss early on.

Getting the structure right from the start makes everything that follows a lot easier. Send us a DM or an email today to discuss your options.

MCA issues usually don’t start with a lawsuit.

It starts with emails, then calls, then a notice of default. Next thing you know, you’re being served with a summons and complaint.

At that point, the clock is running. Timelines are tight, and mistakes are costly.

One of the biggest mistakes we see is people trying to file their own answer just to buy time. In most cases, it limits your options before you even get started.

If you’ve been served, that’s when a lawyer should step in. Early strategy makes a difference.

Bankruptcy isn’t the end — it’s a restart.

If you’re feeling overwhelmed by debt, you’re not alone, and you don’t have to navigate it alone either.

We recently worked with someone facing a confusing and stressful financial situation involving a family member’s account. They were being held responsible for an issue they didn’t cause, and the pressure was mounting. Thankfully, we were able to step in, sort through the details, and help them find a way forward.

At Vilella Law, we know that financial trouble can happen to anyone, even those who are doing their best to help others. What matters most is how you move forward.

Free, confidential consultations available.
Let’s talk about your options, your rights, and what comes next.
