If the car that struck you was still moving and was hit from behind by another driver, there may be two responsible parties: the driver who started the chain reaction and the car that struck you, because they were still moving and had an opportunity to bring their vehicle to a stop before hitting you.

A lot depends on what the middle car was doing. Were they on their cell phone? Were they paying attention? Did the vehicle have adequate braking capability? Were the tires sufficient, or were they bald and unable to stop even when the brakes were applied?

In a chain reaction crash, there may be more than one insurance company responsible for the payment of your damages. Normally, the vehicle that hit you would be responsible for paying for your damages. But in some circumstances, it could be more than one vehicle — for example, both the vehicle that started the chain reaction and the vehicle that struck your car.

That's why chain reaction cases need to be thoroughly investigated. You need to review the police report and talk to witnesses to understand exactly what every driver was doing at the time of the first impact.

The answer is no — medical negligence and medical malpractice are one and the same. Medical malpractice is the failure of a medical provider to follow the standard of care.

Every profession has rules. If you are an athlete, whether you play football or basketball, there are certain rules and regulations that must be followed. The same is true of the medical profession — those rules and regulations are called the standard of care.

The standard of care requires a medical provider to deliver care to the patient that is reasonable and accepted by the medical community as reasonable and acceptable care. If a provider fails to meet that standard, it may constitute medical malpractice.
