What is a Chapter 7 Bankruptcy, and what does it do?
A Chapter 7 Bankruptcy gives an honest debtor a forgiveness of most unsecured, general debts, such as credit cards, lines of credit, medical bills, deficiencies, etc., while it allows you to continue to pay on secured loans, such as home mortgages or car loans. In order to qualify for a Chapter 7, a person must pass a means test, to show that your income is not sufficient to pay off the debts within a reasonable amount of time. A normal, "no-assets" Chapter 7 Bankruptcy takes about 4 months from the date of filing until the discharge order is filed. I usually describe a Chapter 7 as "liposuction for debt" whereas a Chapter 13 is like "diet and exercise for debt" because a Chapter 13 is a restructuring of debt where payments are made over 3 to 5 years.
