It’s important to know the difference between consent and custody. The Miranda advisement isn’t required unless the person is in custody. Once a person is free to go, answering questions and allowing a search becomes consensual. Whether a person is free to go depends on the circumstances, but if unsure, it helps If they ask, “am I free to go?”
