Goldman & Pease, LLC recently secured possession of a residential unit on behalf of a landlord client after extensive eviction litigation in the Eastern Court.

The matter arose after the tenant obtained the tenancy through material misrepresentations on her rental application, including the concealment of three prior Housing Court actions for nonpayment of rent. During the proceedings, evidence demonstrated that the tenant also submitted falsified financial documents, including fabricated pay stubs and an employment agreement, falsely representing annual income in excess of $250,000 over a three-year period.

Throughout the case, our firm successfully prosecuted the summary process eviction action for non-payment of rent and defended against three separate post-Judgment Motions to Stay Ex*****on, each of which sought to delay enforcement of the judgment for possession. The Housing Court denied each motion, allowing the ex*****on for possession to remain in full force and effect.

Goldman & Pease, LLC firm recently secured a favorable outcome for a property owner facing a significant mechanic’s lien claim arising from a tenant improvement project.

A builder retained by the tenant recorded a Notice of Contract, and Statement of Account in the amount of $900,000.00 against the property and subsequently filed a lawsuit against the client/property owner seeking to perfect and foreclose on the lien. The property owner had not contracted directly with the builder and was exposed to substantial risk despite having no contractual relationship with the claimant.

On behalf of the property owner, Goldman & Pease, LLC served a Motion to Dismiss the Complaint and a Motion to Discharge the Mechanic’s Lien, demonstrating that the builder lacked a written contract as required to support a valid lien claim. Based on these deficiencies, the builder’s attorney voluntarily dismissed the lawsuit and discharged the mechanic’s lien in its entirety.

Property line disputes are a common source of conflict between neighbors in Massachusetts, particularly when fences, driveways, sheds, or landscaping encroach across boundary lines. One legal doctrine that often arises in these disputes is adverse possession, which can result in a transfer of ownership without a traditional sale or deed.

What Is Adverse Possession?

Under Massachusetts law, a person may acquire legal title to another’s property through adverse possession if they can prove actual, open, notorious, exclusive, and adverse use of the land for at least 20 years. Each of these elements must be satisfied, and the burden of proof rests with the party claiming ownership.

Importantly, adverse possession does not require bad faith. In many cases, the dispute arises from long-standing mistakes about boundary lines rather than intentional encroachment.
