O'Connell Law LLC

O'Connell Law LLC We are a law firm focusing on Wills & Trusts, Elder Law (Including MassHealth Applications), and Prob

Here are somethings to know about us:

1) When one thinks of a law firm they imagine suits, big desks, intimidating surroundings, and overall stuffiness. We work hard at being the very opposite of that and to be "normal" people who just happen to have some helpful skill sets. At the end of the day, our goal is not to impress you with fancy offices and clothes. Our goal is to help you solve your pr

oblems and give you peace of mind.
2) Being attorneys and staff members at O'Connell Law is something we take pride in and know is important. But we also know that it does not compare with the importance and gratification of being committed partners, parents, and daughters. Our virtual setting is allowing us to balance these roles in a way that works best for our families and also our clients and their loved ones.
3) We truly understand that conversations about death, sickness, money, and family can be difficult because we have been in our client's shoes. We have had to do our own planning, we have gotten sick, our family members have gotten sick, and we have lost loved ones. Because of this, it is so important for us to create a space which is inviting and warm for these conversations to happen, information to be shared clearly, and for us to use plain-language to make things easy to understand for our clients and their families.
4) Legal services can often be expensive and we work hard to control costs, use flat fees, and provide flexible payment arrangements.

Did You Know? πŸ“‹

A will cannot distribute assets that are already assigned through beneficiary designations or joint ownership.
Beneficiary designations on retirement accounts, life insurance, and payable-on-death accounts transfer directly outside your will. Joint ownership with right of survivorship also bypasses your will entirely.

This is why coordinating your will with all beneficiary designations is essential to ensure assets go to the right people.

Legal preparation ensures a trusted person can make decisions if you cannot. πŸ›‘οΈ βœ… Financial authority βœ… Medical decisions βœ… Legal representation Incapacity planning protects you from court-appointed guardianship or conservatorship by designating trusted individuals to handle your affairs if illness or injury leaves you unable to make decisions. This includes powers of attorney for financial matters, healthcare proxies for medical decisions, and advance directives for end-of-life care. Without these documents, your family faces costly court proceedings and may have no say in who makes decisions on your behalf. Protect your future. Call O'Connell Law at (508) 202-1818 or visit www.oconnelllawgroup.com to establish incapacity planning documents.

Some states, including Massachusetts, have estate tax thresholds that may affect how assets are distributed. πŸ“Š Massachusetts has one of the lowest estate tax thresholds in the country at just $2 million. Many families don't realize they're subject to estate tax because they think it only affects the ultra-wealthy. Real estate appreciation alone can push estates over this threshold. Strategic planning through lifetime gifting, trust structures, charitable giving, and spousal transfer strategies can minimize or eliminate estate tax liability while preserving wealth for your beneficiaries. Worried about Massachusetts estate tax? Contact O'Connell Law at (508) 202-1818 to explore tax minimization strategies.

Some estates include valuable property but limited cash, which can affect how taxes and expenses are paid. πŸ’° Estate liquidity refers to how easily your estate can access cash to pay debts, taxes, and administrative expenses. If most of your wealth is tied up in real estate, business interests, or retirement accounts, your heirs may need to sell assets quickly at unfavorable prices to cover estate costs. Planning for liquidity through life insurance, maintaining cash reserves, or structuring assets strategically ensures your estate can meet its obligations without forcing asset sales. Concerned about estate liquidity? Call O'Connell Law at (508) 202-1818 or visit www.oconnelllawgroup.com to discuss solutions.
