Wow this summer has been busy! All the universities have been trying to wrap up all their Title IX cases during the pandemic situation. Students had to deal with responding to charges in the midst of all the craziness of a pandemic. Most have turned out pretty well for those falsely accused. It the few that didn’t, we are fighting the schools in court!! The new TITLE IX REGULATIONS ARE OFFICIALLY OUT!! These regulations give more due process for accused students and alleged victims. They are just better all the way around ! If your university has not posted their Title IX processes under the new regs they in violation federal law.

Just found out we won a title nine Case that has been haunting my poor client for over a year! So happy for him and so happy that justice prevailedAnd we did not have to file a lawsuit! Happy weekend everybody!!

We have been waiting a long time for the new title nine regulations and they are finally here! They are good for alleged victims and accused students, it’s a win-win!

The U.S. Education Department has finalized campus sexual assault rules that bolster the rights of students who are accused of assault and harassment, reduce legal liabilities for schools and colleges, and narrow the scope of cases they will be required to investigate.

Despite the pandemic and all of the stay at home orders, Title Ix investigations and decisions continue in colleges across the United States. The students are not actually at the colleges, classes are online, but they are still forced to do hearings and investigative interviews through Zoom or Skype. Although most of my clients are anxious to get these investigations behind them, there are some serious due process issues looming about these procedures during this unusual time.

Won a Title IX case today- 2 charges dismissed because there was evidence of innocence!! Its a shame that in title ix you have to PROVE your INNOCENCE but always good when you can!

Merry Christmas and happy holidays everyone! I hope everyone has an opportunity to regroup and relax and gain encouragement from their family and friends. This especially goes for all my students facing Title Ix issues right now. Try to enjoy the holidays and put all of this nasty Title Ix business in the back of your mind if you can!

Title Ix is nothing if not disturbing, however an even more disturbing trend has been occurring. More and more women have been filing charges claiming things along the lines of: he kept me up late; he made me drive him to waffle house when I was tired; he wouldn’t let me study; he didn’t get along with my friends; he was mean to my friends; he did not like it when I hung out with my male friends.

Title Ix has become a surrogate “mother” to whom you can tattle on your boyfriend’s behavior. Title Ix is about sexual assault not tattling on unwanted behavior. I don’t understand how schools can even take charges like these seriously. It’s time to grow up!!

We are still waiting for the new title nine regulations to be Published. For those of you who are holding your breath, I don’t have any special insight except that I know I have an appointment to speak with the Department of Education the first week of February, so they won’t be released before then.
