Seth Ogden’s latest article explores the decades-long “Metall auf Metall” dispute involving Kraftwerk and the evolving legal framework around music sampling in the EU. The article examines the CJEU’s recent 2026 decision addressing when sampling may qualify as a protected “pastiche” and the broader tension between copyright protection and artistic expression in modern music.

A new PTAB memo could reshape institution strategy.

The USPTO will now consider U.S. manufacturing ties and small-business status when deciding whether to institute IPR and PGR proceedings. This adds a new policy-driven layer to discretionary denial analysis.

For patent owners and petitioners alike, PTAB disputes may now turn on the manufacturing footprints of both accused infringing products and competing patent‑owner products.

Associate Attorney Samuel Raque explains the key changes and practical implications.

We’re proud to share two recent successes advocating for veterans:

Case One: After more than five years pursuing a disability claim for a secondary condition, including an appeal to the Board of Veterans’ Appeals, a 40% rating was secured for the veteran.

Case Two: After a veteran’s disability claim had been rejected, leading the veteran to stop pursuing the claim, we reopened the claim using the supplemental claim pathway, as well as filing a new claim for an additional disability, and obtained a 70% combined rating for the veteran.

Outstanding work by Seth Ogden and Caitlin Carter, whose dedication and persistence helped achieve meaningful results for these veterans!

In a decision blending hip-hop mystique with intellectual-property nuance, the Eastern District of New York refused to dismiss trade secret claims over the Wu-Tang Clan’s one-of-a-kind album, Once Upon a Time in Shaolin. U.S. District Judge Pamela K. Chen held that the album could plausibly qualify as a trade secret under both the Defend Trade Secrets Act (DTSA) and New York law.
