TN Baby Doe is operated on behalf of multiple district attorneys general serving several judicial districts in Tennessee who are collectively suing prescription opioid manufacturers for their role in the opioid epidemic. The suits are filed on behalf of the communities each DA represents and the babies born with Neonatal Abstinence Syndrome (NAS) as the tiniest victims of the crisis. A lawsuit filed on behalf of six Nashville children born dependent on opioids as a result of exposure in utero was filed in Davidson County Circuit Court this summer and was moved to federal court last month.
The suit seeks compensation for these children, collectively known as the Baby Doe Plaintiffs, from a long list of drug producers, distributors, pharmacies, and pill mill prescribers for the harm inflicted on these children by the defendants’ exploitation of the illegal opioid market.

“There have been thousands of children that have been born in Tennessee dependent on opioids, and we intend to file suit on as many as we can,” said Tricia Herzfeld, partner at Branstetter, Stranch & Jennings, the law firm representing the children and their guardians.

A number of executives pled guilty to misdemeanors. A fine was paid. But most importantly, the key evidence in the prosecution memo was never revealed. It was buried.
