Signed a liability waiver for your child at daycare or the gym? That piece of paper might not mean what you think it does.
In Tennessee, parents cannot legally waive their children’s injury claims without the approval of a judge.
If a facility was negligent—like knowing about a defective condition and failing to repair it—that waiver is not enforceable. Instead of getting blocked by a contract, you can still pursue a premises liability claim based on the actual merits of what happened.
