The case was a victory against prescription drug monopolies, which delay the availability of less expensive generic drugs and artificially inflate the cost of health care. We are delighted that the TJC will be able to use these funds to help indigent Tennessee citizens access healthcare and provide additional assistance to those in need throughout our state.

This award comes from the settlement of an antitrust class action against Mutual Pharmaceutical Company Inc. The suit was filed in 2012 on behalf of individuals and entities in 29 states who purchased the muscle relaxer Skelaxin and its generic equivalent metaxalone between 2005 and 2014. The U.S. District Court for the Eastern District of Tennessee approved a $9 million settlement with the company and selected TJC to receive the award from funds that were undistributed to class members! The Metropolitan Council of Nashville and Davidson County voted Dec. 20 to approve a $450,000 settlement to Joshua Lipscomb, the firefighter who was suspended by the Nashville Fire Department (NFD) for a February 2022 social media post he made under a pseudonym without mentioning the fire department.

“This is a very significant victory for free speech,” says Tricia Herzfeld of Branstetter, Stranch & Jennings, PLLC, who represented Lipscomb along with civil rights attorney Abby Rubenfeld of Rubenfeld Law Office, PC. “You don’t give up your rights to free speech just because you work for the government. Josh stood up for himself and all firefighters by challenging this illegal conduct. We are pleased with the results.”

Judge (ret.) Jack Garvey and daughter Colleen Garvey announce their partnership with Branstetter, Stranch & Jennings (BS&J), PLLC, at the firm's new satellite office in St. Louis, Missouri. Judge Garvey has 35 years of experience in the private practice of law, while Colleen, a St. Louis native, recently served at a top insurance defense firm in the area.

“Colleen and I are excited to join BS&J here in St. Louis,” Judge Garvey said. “We look forward to helping protect the rights of St. Louis-area citizens who have been wronged by third-party misconduct or carelessness.”
