Most people hurt in accidents assume they cannot recover if they were even partially at fault. That is not how New Hampshire law works.
NH follows a modified comparative negligence rule:
Under 50% at fault? You can still recover compensation, reduced by your percentage of fault.
Example: 30% at fault on a $100,000 case = $70,000 recovered.
50% or more at fault? No recovery is available.
This makes evidence everything. The stronger your documentation of the other party's fault, the lower your own fault percentage, and the higher your recovery. Do not let the insurance company assign you more fault than you deserve.
