Carrying a firearm without a license is not just a criminal offense — for immigrants, it can be life-changing. Even if you have lived in the United States for years, an arrest or conviction for unlicensed gun possession can trigger serious immigration consequences.

In many cases, gun-related offenses may be classified as deportable crimes, can lead to mandatory ICE detention, and can block you from applying for a green card, citizenship, or other immigration benefits. Even a dismissal or a continuance without a finding can show up in immigration records and cause unexpected problems with USCIS or ICE.

If you or someone you know has been charged with possessing a firearm without a license, it is crucial to seek legal guidance immediately to protect both your criminal case and your immigration future. Your rights, your status, and your ability to remain with your family may depend on the decisions you make right now.

📢 Important Update: Aged-Out Children & Cancellation of Removal 📢

A recent court ruling has upheld the Board of Immigration Appeals’ (BIA) decision affecting parents who seek cancellation of removal based on a qualifying child. Here’s what you need to know:

If your child was under 21 when you applied for cancellation but turns 21 before your application is decided, they no longer qualify as a “child” under INA §240A(b)(1). This means you may lose eligibility for relief. In a recent case, Diaz-Arellano v. Att’y Gen., the court denied relief because the petitioner’s daughter had aged out and he hadn’t taken steps to expedite his case.

🚨⚖️ 3 Costly Immigration Mistakes to Avoid! 🚨📃

Navigating your immigration journey is complex, and there are a few common mistakes that could put your American Dream at risk. Let’s break down the top 3 pitfalls to avoid and keep your path to success clear:

1. 🗣Listening to Others Instead of a Legal Expert
Every immigration case is unique, so taking advice from friends, family, or online sources can lead to big mistakes. Consulting a licensed immigration attorney ensures you're getting reliable guidance tailored to your specific situation.

2. 🚫 Comparing Your Case with a Friend's Case
Even if someone you know had a “similar” case, small differences can lead to different results. Comparing cases can cause unnecessary stress and confusion. Focus on your unique journey and consult with a professional who understands your specific needs.

3. 💵 Choosing Non-Lawyers to “Save Money”
Hiring a non-lawyer or unlicensed consultant to save a few dollars can end up costing you far more in delays, errors, and even denials. Remember: sometimes the cheapest route can come with the highest price, jeopardizing everything you've worked toward.

Stay informed, seek the right guidance, and safeguard your path to a new life.

📉 Border Encounters Reach Record Lows

U.S. Customs and Border Protection (CBP) recently announced a significant decrease in irregular border crossings. The southwest border saw its lowest encounter levels since 2020, dropping by 32% from June to July 2024. The decline is attributed to enhanced border measures and cooperation with international partners. This decrease highlights the impact of policy changes aimed at deterring unlawful crossings and combating human smuggling.

CBP also noted that in July alone, over 92,000 individuals were removed or returned to their home countries. The agency continues to expand efforts with humanitarian aid and enforcement operations. Learn more about CBP’s latest updates on lawful pathways and border safety.

⚖️ Deportation Defenses🏛

Facing immigration court can feel overwhelming, but there are various defenses available that can help you stay in the U.S. Here are some common options:

- Marriage to a U.S. Citizen: If you are married to a U.S. citizen, you may be eligible to adjust your status.

- Asylum: If you fear persecution in your home country due to race, religion, nationality, political opinion, or social group, you can seek asylum.

-Withholding of Removal: Similar to asylum but with a higher burden of proof, this option can protect you from being deported to a country where your life or freedom would be threatened.

- Cancellation of Removal: For certain non-permanent residents who have been in the U.S. for 10 years or more and can prove extreme hardship to a U.S. citizen or permanent resident family member.

- VAWA: If you’ve been a victim of domestic violence by a U.S. citizen or permanent resident spouse, you can self-petition under the Violence Against Women Act.

These are just a few defenses available. Each case is unique, so it's essential to explore all options with an experienced immigration attorney.
