WWMR Real Estate Partners Michael Michetti, Josh Rudnick and Jay Caudill are getting ready for another season in SW FL. As such they want to remind everyone that there are benefits to hiring an attorney to handle your real estate closing.

When selling real estate in Florida there are two different options to consider in regards to obtaining title. Both title companies and law firms may issue titles; but due to legal issues that often come up during the process of selling property, retaining a law firm may kill two birds with one stone.

All-in-One

One of the most important advantages of having an attorney as a closing agent is that you are able to receive legal counsel from the moment that the firm is retained. This can span from negotiations and preparation through closing. Attorneys are able to solve many problems that may arise using innovative legal strategies that a title company may not be qualified to offer.

Got Your Back

Another factor to consider is that the title company is motivated to close the deal; which may result in bias, an inability to have your best interest in mind or provide completely forthcoming guidance. An attorney, on the other hand, has an ethical responsibility to protect their client. This places the attorney in a position where the best interests of the client are truly top priority.

It is always important to have an attorney prepare or review the documents to ensure no mistakes were made and both parties will be happy with the terms of the transaction. Additionally, some transactions require non-standard documents that require careful legal drafting. It is not uncommon for attorneys to receive phone calls from individuals or realtors who have run into legal problems mid-way through the process or even on the day of closing. This mistake can be costly and extremely stressful.

Typically, the difference in the cost of an attorney closing as opposed to a title company closing is nominal, if anything. Therefore, all of the stress and extra costs of hiring an attorney midway through the closing process can be avoided by obtaining legal counsel up front rather than just a title company. With an attorney you can rest assured that your best interests and complete satisfaction are a priority, the documents were drafted correctly and reviewed before signing, and you will avoid any potential costly mistakes during this important process. Why wouldn’t you want this peace of mind during something as important to you and your family as your residential sale or purchase?
