"We talked about who would take the kids."

It's one of the most common things we hear from parents. And while that conversation is important, it's only the beginning.

An agreement that lives in your head—or even a conversation shared with family—doesn't give anyone legal authority to step in when it's needed most.

If something happened unexpectedly, would the people you trust most actually be able to care for your children right away? Or would important decisions be left to a court?

This week's article explores why naming a guardian in your will isn't always enough—and what every parent should know about protecting their children.

Most parents have thought about who would raise their children if something happened to them.

But here's the question almost no one asks: what happens in the first 72 hours?

Who can pick your children up from school? Who can make medical decisions? Who can step in immediately before a court has time to act?

A complete Kids Protection Plan® addresses both the long-term guardian and the people who have legal authority to care for your children right away. Because when there's a gap in the plan, it's your children who feel it.

Do you need to name legal guardians for your children? We're here to help.

👨‍👩‍👧‍👦 Most parents believe they've answered the question: "Who would raise my children if something happened to me?"

But here's what many don't realize: naming a guardian in your will may not be enough.

Who can step in immediately if there's an emergency? Who has the legal authority to care for your children before a court can act? And what happens if your wishes aren't clearly documented?

These are questions every parent should understand before they become urgent.

Most estate plans explain what happens to your assets when you die.

Very few address what happens to your surviving spouse’s taxes afterward.

The widow penalty is real, and many families do not discover it until it is too late to plan around it.

As a Personal Family Lawyer® Firm, we believe these conversations should happen before a crisis, not after one.

There is a question most estate plans never ask: what does life actually look like for the person left behind?

Most planning conversations focus on documents. Who gets what. How assets pass. What the trust says.

But what about the surviving spouse’s day-to-day financial reality?

Will retirement income suddenly be taxed differently?
Will Medicare premiums increase?
Will required distributions create unnecessary tax pressure later?

These are the kinds of questions many families do not discover until after a loss, when some of the best planning opportunities have already passed.

As a Personal Family Lawyer® Firm, we believe estate planning should go further than document preparation alone. A well-designed Life & Legacy Plan considers not only what happens to your assets, but how the surviving spouse will actually live financially in the years that follow.

If those conversations have not been part of your planning yet, they should be.

The widow penalty is not a vague concept. It has a very real dollar figure attached to it.

In 2026, the standard deduction for a married couple over 65 is $35,500. For a single filer, it drops to $18,150. That one change alone can create more than $17,000 of additional taxable income, before anything else in the surviving spouse’s financial life has changed.

And for many surviving spouses, that is only the beginning.

Higher tax brackets. Higher Medicare premiums. More Social Security taxed.

Most families do not discover these issues until after one spouse has died, when many of the best planning opportunities are already gone.

Our latest article explains what the widow penalty is, why it matters, and what families can do now to help protect the surviving spouse later.

Most couples plan for what happens when one spouse dies.

Very few plan for what happens to the survivor’s taxes.

The same retirement income. The same savings. The same house.

But suddenly:
• Higher tax brackets
• Higher Medicare premiums
• More Social Security taxed

All because one spouse is now filing alone.

It’s called the widow penalty, and most families do not learn about it until it is already happening.
