EB-5 Regional Center program now accepting I-526 Petitions at $800,000 and $1,050,000. Concurrent filing of I-485 Adjustment of Status, Employment Authorization and Travel Documents also permitted.

If you are lawfully present in the US and file an I-526 Petition or if you have a pending I-526, you are eligible to file concurrently, but this does not apply to visa waiver cases.

Presidential Proclamation Suspending the Entry of Certain Nonimmigrants into the United States –

What You Should Know

Here’s What We Know

On June 22, 2020, President Trump issued Presidential Proclamation 10052, which suspended the entry of foreign nationals on certain employment-based nonimmigrant visas into the United States as of June 24, 2020, at 12:01 am (ET).

This Proclamation also extended Presidential Proclamation 10014 issued on April 22, 2020, which suspended the entry of certain immigrants into the United States.

The suspension of entry for certain immigrant and nonimmigrant visas will remain in effect until at least December 31, 2020.

The nonimmigrant ban applies to individuals applying for an:

• H-1B visa and a dependent H-4 visa;

• H-2B visa and a dependent H-4 visa;

• J-1 visa, to the extent the foreign national is participating in an intern, trainee, teacher, camp counselor, au pair, or summer work travel program, and a dependent J-2 visa; and

• L-1 (L-1A and L-1B) visa and a dependent L-2 visa.

The nonimmigrant ban will only apply to an individual identified above if he or she:

• Is outside the United States on the effective date of the Proclamation;

• Does not have a nonimmigrant visa in one of the categories that is now suspended on which he or she is seeking entry, that is valid on the effective date of the Proclamation; and

• Does not have an official travel document other than a visa (such as a transportation letter, boarding foil, or advance parole document), valid on the effective date of the Proclamation or issued thereafter permitting the individual to be admitted to the United States.

The Proclamation does not apply to the following individuals:

• Visa-exempt Canadians;

• Lawful permanent residents;

• Spouses or children of U.S. citizens;

• Individuals seeking entry to provide temporary labor essential to the U.S. food supply chain;
• Individual whose entry would be in the national interest, including individuals whose services are critical to defense, diplomacy or national security, related to the combat of COVID-19, will facilitate economic recovery and are children who would age out of eligibility.

President Trump tweeted that he plans to sign an EO to temporarily suspend immigration to the United States. A few things to know:

1) The executive order has not been signed! Currently, it is no more than a tweet and has no legal bearing. The law has not changed.

2) If an executive order is signed, it is intended to be a "temporary suspension", not a permanent ban, and so most immigration processes will continue, although there may be delays in processing and issuing visas.

3) It is intended to curb immigration to the States and may or may not include cases such as yours.

Office procedures during the COVID-19 Pandemic

Like many of you, I have been following the news cycles in an attempt to determine the best course of action to provide both service, as well as safety, to our staff, neighbors, and valued clients.

As of the writing of this email, The Korda Law
Firm plans to continue our normal business hours with few changes. Our staff will be available via phone and email during normal business hours. We ask that, prior to coming to our office, you follow the recommendations as laid out by the Center for Disease Control as found here:

We ask that if you have travelled abroad recently that you refrain from an in-person visit to our office, rather opting for service via phone and/or email. Also, if you have been ill during the last two weeks, we ask the same.

During this time, our office will not be accepting cash payments for services as handling cash creates an increased risk for our staff

Rest assured I will continue to monitor the protocols as set forth by the Center for Disease Control, as well as state and local government officials, and will communicate any changes to our office procedures accordingly.
