Even a Polygraph Can Lie
Situation:

A young African-American man is accused of ra**ng a teenage girl. The only evidence is verbal: the girl’s statement to a deputy sheriff and the young man’s supposed “confession” during a polygraph exam. There is no forensic evidence: no fibers, no fingerprints, no hair, and no fluids. No SART (Suspected Abuse Response Team) exam was performed. There were only words.

During interrogation, a deputy sheriff tells the young man that if he tells the truth, they won’t think he’s a ra**st, or even a “criminal.” They say he should get what he’s done off his chest and they won't think he’s a bad person. But if he lies to them, and continues to deny what he’s done, they will think he’s a criminal. They never turn on the polygraph machine he’s hooked up to, and they never tell him that it’s not on.

And the young man never says that he committed any assault. Instead, his interrogators tell him that they know that he did it, and get him to agree to this by saying that if he just says “yes” to them, everything will be okay and they won't think he’s a criminal. They don't exactly tell him they'll let him go, but they do say, over and over, he won't be a “criminal” if he'll just agree with them.

Trial:
With no forensic evidence and no actual, true confession, the young man is found not guilty.

"Not only is he always available to answer all my legal questions fully but he got my case completely dismissed without me having to be there. As a nursing mother facing jail time, he is my hero!

Drug Charges with Search & Seizure Case Study:
Your House is Your Castle
Situation:

Officers stop a package in the mail that has a lot of money in it (they can tell this by X-ray). The officers dress up as postal workers, and try to deliver the package of money to the addressee, thinking they'll get inside the residence, poke around, and arrest him. They never get a search warrant.

The police ring the bell, get no answer, and go around to the back of the residence, where the door is slightly open. They go inside, smell ma*****na, search the whole place, and arrest everyone there.

Hearing:
The judge agrees that just because the back door was slightly open, there was no reason for the officers to assume that there had been a burglary and enter without a warrant. The case was dismissed, and the money was returned.

“I hired Michael when my children were suddenly removed from my custody by LA County DCFS on extremely tenuous grounds.

Due to Michael's tireless efforts, I was able to get them back at the earliest possible moment, at the initial detention hearing. I have since been told that this rarely happens. Once DCFS gets their claws into your family, it can take months to get your children back.

The trial was then set for two months after the detention hearing. During those 2 months, Michael was constantly in touch and working to secure a dismissal at the trial. I was always kept fully informed about my case and any possible outcomes/potential difficulties.

This gave me peace of mind during an extremely stressful time. The case was dismissed with prejudice at the trial hearing, meaning that DCFS could no longer legally harass my family. I would recommend Michael to anyone battling with DCFS. He should be on the emergency number list for anyone with kids.

My experience has shown that DCFS can show up unexpectedly at *anyone's* door. If they are not handled correctly, the situation can quickly turn into a nightmare.”

Everyone charged with a crime, whether for theft or fraud, must go through a legal process in court.

At the beginning, all people accused of a crime have a right to be notified of the charges they are facing.

The legal process may end with a trial to determine guilt or innocence. However, there are many important steps between these two events.
