Joshua T. Crain, Attorney at Law

Joshua T. Crain, Attorney at Law Murfreesboro Criminal Defense Attorney I am a former state prosecutor with extensive trial experience. I am tough, fair, and honest.

I have handled cases ranging from minor traffic offenses to murder. Over my career I have worked hard to develop a positive reputation in my community and among my colleagues. If your circumstances require the counsel of an attorney, I would be honored to speak with you. Above all, I know that I answer to Christ and my actions in this life I will be held to account for before him.

Memories and passions are short lived, unless you are the one affected and needing answers. I’ve watched it happen time and time again in my career. Cases get opened, investigations are hot, and then . . . NOTHING. New cases get opened, new crimes need the attention of law enforcement, administrations change. But the families are still there wanting answers. I also know that sometimes the answers aren’t what the families want to hear. But one thing is always true, families deserve someone to be honest with them.

At Crain Law, I am opening a Cold Case Division that will be comprised of myself and hand-selected investigators who will tackle cold cases and try to bring closure to families wanting answers. We will review and selectively choose cold cases to work where we think we could make a difference. Hopefully, this will give families another option and some hope.

Do Judges Ever Change Their Minds on Sentencing?
Once you’re convicted of a crime in Tennessee state or federal court, there’s generally a delay between the conviction and your sentencing hearing. During this period, judges are meant to review evidence from both defense attorneys and prosecutors regarding the proper sentence in your case. A dedicated Tennessee sentencing reduction lawyer might present evidence to mitigate your sentence or, if necessary, file a petition for resentencing to convince the judge to change her mind.

What is Probable Cause?
When someone is stopped by police, arrested, or searched, one of the most critical legal standards that comes into play is “probable cause.” In Tennessee, as in the rest of the United States, probable cause is a constitutional requirement that protects individuals from unlawful searches, seizures, and arrests. But what exactly does it mean, and how can it affect your case? The Law Office of Joshua T. Crain can help you with all of your questions.

It’s time for the bullies to be held accountable. Unfortunately, too many school administrators embolden the bullies because there are no consequences for their behavior. Instead, victims are told to modify their behavior to lessen the impact of the bully. It’s classic abuser mentality (blame the victim) supported by the inaction of school administrators. Time and time again we see young people commit su***de because they can’t tolerate the abuse any longer. Yet we almost never see the bully held accountable. I’m tired of it. I’m tired of watching it happen and I’m tired of experiencing it within my own family.

I am launching my own investigation using my own investigator who has been working with me for years. We will not be fooled by the gaslighting of the bully. My goal is to interview as many people as possible that are victims of bullies and put together an actual plan to hold these people accountable in the criminal justice system. Though I am a lawyer, I am always hesitant for young people to end up in the criminal justice system as a way to solve what should be solved other ways. However, when nothing else is being done and the bully is allowed to operate without consequences it becomes necessary.

I will not tolerate this any longer. It’s not fair to the many young people that are being robbed of opportunities, tracked down in public places to be berated, and otherwise tormented. It’s pathetic for the parents of bullies to actively engage in the bullying without consequences.

It’s time for people to stand up against the bully and their enabler.

In Rutherford County, if your child has been bullied by the usual suspects, call my office and let’s put a plan together to hold them accountable.

What is an Indictment?

Being charged with a crime can feel overwhelming and confusing, especially if you hear terms that are unfamiliar, like “indictment.” In Tennessee, the indictment process plays a crucial role in determining how felony cases proceed in court. Understanding what an indictment is, how it works, and what it means for your case can make a significant difference in how you respond to criminal charges.

Penalties for Not Complying with a Field Sobriety Test

When an officer suspects a driver of being under the influence of alcohol or drugs, one of the most common tools used in roadside investigations is the field sobriety test. These tests are designed to evaluate a person’s physical and cognitive abilities to determine if they are impaired. While the tests might seem simple, they are often more complicated than they appear—and the decision to refuse or comply can carry serious consequences.

What Makes a Crime Aggravated in Tennessee?
In Tennessee, not all crimes are treated equally. While many offenses fall under standard classifications such as misdemeanors or felonies, certain actions or circumstances can elevate a crime to an aggravated offense. An aggravated crime typically carries harsher penalties and greater long-term consequences. Understanding what makes a crime “aggravated” under Tennessee law is essential—especially if you or a loved one is facing serious criminal charges.

Can You Get Arrested for Jaywalking?
The first jaywalking laws in the United States arose in 1912, and it was not long until the entire country had adopted these traffic regulations. Jaywalking today can be particularly dangerous, especially when you consider the number of negligent drivers on our roads. But can you really go to jail if you jaywalk in Tennessee? Can a traffic defense attorney help you avoid serious penalties for this seemingly innocent crime?
