What is probation?

Probation is a sentencing alternative to incarceration that allows a defendant to serve a sentence in the community instead of in jail or prison. You can be sentenced to serve a period of time on probation in addition to, or in lieu of, being sentenced to a period of incarceration. Typically, the judge will actually sentence you to a period of incarnation and then suspend that time and allow you to serve that time on probation instead. What are the steps in a divorce?

A divorce begins when one spouse (the “Petitioner”) files a “Request (Complaint) for Divorce.” The Request must be served on the other spouse (the “Respondent”) to ensure that he/she is aware of the proceedings and is given an opportunity to respond. If the Respondent files a written “Answer” it means both parties are planning to actively participate in the process. If no Answer is filed, the Petitioner may request a default judgment after the required waiting period. Ideally, the parties are able to resolve all issues in a Marital Settlement Agreement without the need for lengthy, and costly, litigation. If an agreement is not possible, the Discovery process will begin wherein both sides provide relevant information to each other. Mediation may be ordered by the court in an attempt to avoid a trial. If contested issues remain, the case will be set for trial at which time the judge/jury will decide the outcome of those issues. Learn more about the Tennessee divorce process at

What happens if I die without a Will in place?

When a decedent left behind a valid Will, he/she is said to have died “testate.” When no valid Will was left behind by the decedent, the decedent is said to have died “intestate.” If you die intestate, the State of Tennessee decides how your estate assets are distributed using the Tennessee intestate succession laws. Usually, this means that only close relatives will inherit from the estate in most cases.

How does the divorce process work in Tennessee?

The divorce process begins with the filing of a Complaint by the Petitioner (the person who initiates the divorce). The Complaint, along with a Summons, is served on the Respondent (the other spouse) who then has a limited amount of time within which to file a written Answer. If no answer is filed, the Petitioner can ask for a default judgment. If an Answer is filed, the parties may work out an agreed settlement and file it with the court or the case will proceed to the discovery stage. Mediation may follow. If an agreement is still elusive, the case will eventually go to trial. Learn more at

2) The quantity of drugs involved
3) The defendant’s previous criminal conviction (or lack there of)
4) Whether the defendant cooperated with the police

One of the most common mistakes people make is “talking” to the police when they are just a witness, “person of interest,” or suspect. People frequently think they can talk their way out of being arrested when, in reality, that rarely ever happens. The police are trained to question suspects – they do it every day for their job. If you have not been placed under arrest, or are not officially in custody, the police are not required to read you your rights. That does not mean you are not considered a suspect nor does it mean that what you say will not be used against you if you are arrested.
