Choosing an Executor for Your Estate

The executor of your estate is tasked with inventorying your assets, paying off your debts, and carrying out the instructions in your will. Because this role comes with so much responsibility, nominating an executor is one of the most important decisions you’ll make with your estate attorney. Here are a few tips for choosing the right executor.
1. Choose Someone Responsible
Many people choose an executor based on the strength of their personal relationships, but this isn’t always the best approach. Responsibility and organization skills are the most important qualities for an executor, so select someone with a reputation for being conscientious and efficient. This will help minimize conflict and reduce mistakes that can cause delays and expensive conflicts.
2. Choose Someone Who Can Be Impartial
The executor will have to make decisions about who receives certain assets and settle disputes between your family members. Nominating someone who can stay impartial will reduce the risk of conflict and resentment that can cause long-term damage to family relationships.
You might select a family member who doesn’t stand to inherit a significant amount of your assets. If you’re looking for a truly impartial attorney, you can even nominate an estate attorney.
3. Choose Someone Younger
Choosing someone your own age might seem like the best approach, especially if the person you have in mind is financially sound and responsible. However, an individual of your generation may pass away before you do or be unable to serve as your executor.
Your estate attorney may recommend naming backup executors who will step in if your first choice is unable to fulfill the role. To increase the chances that someone you choose will be available, it's best to select at least one person younger than you.
