I don’t have to repeat how people are struggling due to the price of food, gasoline and every product that is sold since inflation is killing everything and destroying working people.

As a result of the inflation that has been the highest in 41 years, Americans incurred the highest balances on their credit cards in the second quarter of 2022 to $46 billion which is the highest spike in 20 years. As a result of the recession, Americans added $312 billion in mortgage and non-mortgage debt during the second quarter of 2022. The amount of delinquent credit card debt rose to 3.35% and delinquent auto loans increased to 1.81% from 1.61% one year ago. In addition, auto loan balances increased $33 billion during the second quarter of 2022. The data showed that the average price for a new vehicle was over $48,000. Mortgage interest rates for a 30-year fixed rate mortgage as of the end of July 2022 were 5.3% compared to 2.5% a year ago and 2/3 of new mortgages went to borrowers with credit scores of at least 760. If you care for a special needs child, there are a lot of additional expenses that arise due to the child or young adult’s disability.

Since a lot of special needs children cannot express themselves, they express their feelings by destroying things since their brain functions differently due to their disability and it is hard for them to express their anger through verbalizing.

WHERE DO I GET MONEY TO PAY MY BILLS?

So many of you are killing yourselves, working more than one job, to try to make ends meet to pay for food, gas and deal with the inflation that is impacting all of us.

However, the worst place to try to get money is to borrow from your pension, 401k or other retirement plan.

At Taieb Law, since we have been a New Jersey Bankruptcy Lawyer for over 37 years, we have seen how pension loans can totally destroy you in several ways.

First, several of our clients do not realize that borrowing from your pension may constitute income under certain circumstances and this has to be declared on your tax returns. So, you may end up having a large tax liability with Uncle Sam, depending on certain circumstances.

Second, your lives are crushed since you are having huge payments coming out of your pay checks for long periods of time and it just puts you under more financial stress. I am not saying that using credit cards or obtaining a personal loan is good; however, clients do not suffer anywhere as much financially as they do when a huge chunk of their paycheck goes towards paying back a pension loan.

THE MEANS TEST IS KINDER AND GENTLER FOR NJ BANKRUPTCY

How many of you are afraid that you don’t qualify for chapter 7 bankruptcy?

Effective April 1,2022, the numbers for the means test have increased again in New Jersey. If you live alone and have substantial credit card debt, if you earn $75,321, you will qualify for a chapter 7 bankruptcy. (The means test is a formula calculating your income over the last six months). If a husband and wife have $100,000 in credit card debt or any other unsecured debt, they can earn $92,669 to qualify for a chapter 7 under the means test formula. If the husband and wife who have over $100,000 in unsecured debt have a child living with them, they can earn $117,697 under the means test to file. Finally, the median income for a family of four is $140,657. Each additional person in the household adds another $9,900.

In addition, under a present bill passed by the Senate, people will get relief since the total amount of debt which makes you eligible for chapter 13 is $2,750,000 instead of dividing it into secured and unsecured which increased on April 1, 2022. This will sunset two years after it becomes law. This will help people file chapter 13 who used to be excluded if they had too much unsecured debt or too much secured debt and had to either file chapter 7 and lose property or chapter 11 which is much more expensive.

Thus, with the increase in bankruptcy exemptions which became effective on April 1,2022 and the higher number for the means test, a NJ bankruptcy for chapter 7 will be available to many more people.

As a result of the higher means test numbers in New Jersey, it will also benefit consumers who need to file a chapter 13 bankruptcy in New Jersey since in several cases they may be able to get the benefits of reorganizing debt that they are behind such as a mortgage, motor vehicle or back taxes while reducing or eliminating unsecured debt in their chapter 13 NJ Bankruptcy.

How many of you wake up freezing every morning in January? The high temperature the other day was 25 degrees Fahrenheit.

Most people try to keep their thermostat low to avoid astronomical electric bills and you bundle up when you go outside.
