The stronger question may be:

Does the number fit everything else the jury can see?

In NCDD’s newest article, Hunter Tzovarras explains how he defended an OUI case involving a breath-test reading of .16 without relying on a breath-test expert or a technical explanation for the result.

Instead, the defense made the machine the outlier.

The jury saw the driving. They heard the speech. They watched the field sobriety testing. Then they decided whether the number made sense.

On this day in 1789 the first Congress of the United States approved 12 amendments to the Constitution and the states eventually ratified 10 which are known as the Bill of Rights.

There were two amendments that were not ratified The first proposed amendment dealt with the size of the House. Under that amendment, there would be one representative for each 50,000 people. It would mean the modern House today would have over 6000 members if it had been ratified. The second amendment dealt with congressional pay. It was later ratified in 1992 becoming the 27th amendment.
