When people ask me why they should have an estate plan, I explain that one of the main reasons is to avoid . Probate is a usually lengthy proceeding that can be very frustrating and expensive.
Most importantly, your heirs will not have access to the money when they may need it most.
In California, if you have liquid assets exceeding $150,000.00 (not counting qualifying retirement accounts) or $50,000.00 of equity in real property, your estate will likely go through probate without a trust.
