Order of the State Health Officer Suspending Certain Public Gatherings Due to Risk of Infection by COVID-19 (Applicable Statewide) Amended July 29, 2020.” The State Health Officer’s Order, which is incorporated in the Governor’s Proclamation, shall remain in full force and effect until 5:00 P.M. on August 31, 2020, unless extended, rescinded, or modified in writing before that time (see page 11 of the actual State Health Officer order under “Duration”).

The “Safer at Home” order was only slightly amended from the one issued on July 15th by adding the language “or any child who has not yet entered the second grade” in Section 2.a.(i) on page 2 of the Order and by adding the language “and each student in the second grade or above” to Section 14c. at the top of page 9 of the Order. Also, on page 11 of the Order, under Section 21 entitled “Preemption,” it provides that the Order Order. Also, on page 11 of the Order, under Section 21 entitled “Preemption,” it provides that the Order supersedes and preempts all orders previously issued by the county health officers concerning COVID-19 mitigation measures, as well as any municipal ordinances concerning the use of facial coverings to prevent the spread of COVID-19, but further provides that, after the date this Order is issued, county health officers are authorized, after approval by the State Health Officer, to implement more stringent measures as local circumstances require.

Please also note that on page 1 of the Governor’s Proclamation, under I., it provides as follows: “The law-enforcing authorities of the state shall enforce that order as any other order, rule, or regulation promulgated by the Governor under that Act, see id. § 31-9-14, and the penalty for violating it shall be a fine of not more than $500 or imprisonment in the county jail as set forth in the Act, see, e.g., id. § 31-9-22.” If a person is charged with violating the “Safer at Home” order, the charge code “EMER” may be used citing Section 31-9-8, Ala. Code 1975.
