When a court is deciding whether a child should be allowed to relocate, one of the most important considerations is what is in the best interest of the child and how the move will impact the child's ability to maintain a relationship with the parent who is not moving.

The easier travel is, the more financial resources that can be contributed, and the reasonableness of extending summer and holiday visitation beyond the normal limits — if the relocating parent is generous in those terms, that can affect a court's decision.

If you are the parent who has visitation rights in Alabama and you receive notice that the other parent plans to relocate with your child, you need to act immediately if you want to keep that child there.

You have the right to file an objection with the court, but it has to be filed. You cannot just notify the other parent and say you disagree — that is not good enough. You have 30 days from the day you receive the notice to file that objection, and then you have the chance to show the court why your child should not move away.

If you are concerned the custody arrangement for your child is no longer in their best interest, the very first thing you need to do is start documenting everything you can.

Keep a calendar of what is occurring in that child's life, of your time with the child, and of the other parent's time with the child. Get in touch with the teachers and counselors of the child and see if they have any concerns.

It is never too soon to start gathering evidence. And once you are convinced it is time to make a change for that child, we will file a petition to modify custody with the court.

There are a whole series of factors a court is going to look at to determine whether relocation is in the child's best interest.

Remember — it is presumed that it is not in the child's best interest to remove a child from one of their parents. So you are faced with overcoming a legal burden that is against you. You have to show that the child will have a much better, more beneficial life, or that you have to move out of some necessity and it is not going to be detrimental to your child.

If you are in the military and your orders require a move, that is an exception to the relocation law.

In our part of Alabama, we have a unique issue when it comes to relocation. We have something called the Parent-Child Relationship Protection Act — the Relocation Act for short.

If you are going to move more than 60 miles away or across state lines, you have to give notice via certified mail to the other parent. They then have the right to file an objection with the court. If they do, it is up to the judge whether you are allowed to move with your child. And if you say you are going to move no matter what, the court could change custody to the other parent.

The trickiest part for our area is that we live so close to the Florida and Mississippi state lines that a parent may be moving only 30 miles away and still have to comply with the statute.
