The court decision yesterday by the Board of Immigration Appeals regarding travel outside the U.S. with advance parole, shows again that immigration laws are complex and the current administration is doing everything possible to make existing laws and policies stricter. Details matter in immigration. The decisions you make can greatly affect your current, or future immigration case. We urge anyone with a current, or possible future, immigration case who has already travelled with advance parole, or who has already filed for it, to speak to a qualified immigration attorney with experience. Making the wrong decision based on social media posts or based off information online only is not the best choice. USCIS recently announced a change in policy for applications submitted. In the past, if an applicant was missing evidence required for their application, a request for evidence or a notice of intent to deny was issued by USICS which provided time to the applicant to submit the needed evidence. USCIS’s new policy will be that USCIS may directly deny an application without providing an opportunity to submit missing documents. This strict shift in policy means that applicants should make sure they are eligible for the benefit they are seeking with a qualified immigration attorney, and not a notary public, applicants should make sure to contact a qualified immigration attorney with plenty of time to prepare their case, and applications must be well documented from the beginning. Yesterday, the Supreme Court issued two decisions which greatly affect the immigrant community. Regarding TPS (temporary protected status) the Court held that TPS protections for both Haiti and Syria can end without any further review by the Courts & that the Administration is the sole decision-maker to decide which countries are designated for TPS. Attorneys argued on behalf of TPS holders that the process of the decision was flawed & biased. The decision will make it easier for the Administration to end future TPS designations & harder to try to stop the termination of TPS in the courts. We urge any TPS holder to speak to an experienced immigration attorney about their possible options as soon as possible.
The Supreme Court also made a decision that allows the Administration to reinstate a policy from its first term when individuals were turned away at the U.S. border so that they could not legally apply for asylum. The Court stated that to apply for asylum, the individual must have already crossed onto U.S. soil. Thus, the Court will allow this policy to continue in the future which would deny individuals ability to lawfully and properly declare their desire to file for asylum at the border.

Sobre TPS (estatus temporal protegido) la Corte dijo que las protecciones para Haití y Sria pueden terminar sin mas reviso en las cortes y que la Administración es el único para decidir qué países son designados para TPS. Los abogados argumentaron de parte de personas con TPS que el proceso de la Administración defectuoso y sesgado. Esta decisión lo hará más fácil para que la Administración cancela el TPS en el futuro y más difícil para parar la terminación de TPS en las cortes. Se urge que cualquier persona con TPS hable con un abogado de inmigración con experiencia lo mas pronto posible para discutir sus opciones.
La Corte Suprema también emitió una decisión lo cual permite reinstalar la política de su previa plazo cuando individuos fueran rechazados la entrada en la frontera de EE.U. para que soliciten el asilo legalmente. La Corte dijo que para poder solicitar el asilo es necesario ya haber cruzado la frontera con EE.UU. Por lo tanto, la Corte permite continuar con esta política lo cual negaría la capacidad de personas de declarar su intención de solicitar el asilo en la frontera.

Yesterday, the Supreme Court issued a decision which affects lawful permanent residents who wish to travel and have pending criminal charges. When a lawful permanent resident is returning to the United States, there are two definitions that the immigration laws use to categorize the return entry. The Supreme Court now authorizes Customs & Border Patrol agents to make a decision that a lawful permanent resident has a “crime of moral turpitude” only with charges pending with no conviction yet to categorize that person as “seeking admission” into the U.S. which allows the government to directly place the person into removal proceedings (Immigration Court). As such, lawful permanent residents with criminal charges should be aware and careful and speak to an experiences immigration attorney BEFORE travelling outside the U.S. to assess your case. It is also important for lawful permanent residents to have an experienced criminal attorney to represent them in criminal court.

Ayer, la Corte Suprema emitió una decisión lo cual afecta a residentes permanentes legales quienes desean viajar fuera de los EE.UU. y tienen cargos criminales pendientes. Cuando un residente permanente legal está regresando a los EE.UU. bajo las leyes de inmigración existen dos definiciones para categorizar la reentrada. La Corte Suprema ahora da autorización a los agentes de Aduanas y Protección Fronteriza a decidir que un residente permanente legal tiene un “delito de vileza moral” con tan solo cargos pendientes y aun no una convicción por lo cual la persona “está solicitando la admisión” a los EE.UU. lo cual permite al gobierno poner la persona en procedimientos de expulsión (Corte de Inmigración). There are thousands of former clients of this former attorney and there are reports of former clients being unable to retrieve their files and most report having no copies of their own documents. You may consider filing an application with the Client Protection Fund (CPF). To be eligible for payment from the CPF, you must have suffered a loss caused by the dishonest conduct of a lawyer, for example, failure of the lawyer to account for money or property entrusted to them in their practice of law.
when reviewing applications, the CPF Board may consider whether you have exhausted other remedies before applying to the CPF, such as filing a claim through malpractice insurance and/or taking steps to sue the lawyer in civil court. Please be advised that the CPF is a fund of last resort. It can take several months for your application to be processed.
