Winning a trademark case does not automatically mean a court will freeze every seller account and every dollar tied to it.

NASCAR asked for emergency relief against nearly 100 alleged foreign counterfeit sellers on platforms including Amazon and Temu. The judge granted a narrower TRO, but refused the broader asset freeze and account restrictions because the evidence was too thin.

The court’s broader message was striking: e-commerce counterfeiting may have outgrown the legal tools courts currently have.

That is the issue in the fight over Disney’s “Lots-o’-Huggin’ Bear” from Toy Story 3. The court has not resolved the trademark question yet, but it has allowed an immediate appeal because the line between expressive use and commercial trademark use is unsettled.
