Gustafson Gluek is pleased to welcome two new attorneys to the firm. Please join us in welcoming Melanie Miller and Adam Kolb. We are excited to see the contributions these exceptional individuals will bring to our firm!

Melanie Miller earned her J.D. from the University of Nebraska College of Law, where she graduated second in her class. She was nominated for membership in the Order of the Barristers and Order of the Coif. During her time at Nebraska, Melanie earned the CALI Excellence for the Future Award in Evidence, Pretrial Litigation, Trial Advocacy, Business Associations, Employment Discrimination, Advanced Legal Research, Legal Profession, First Amendment, Business of Law and Clinical Practice-Housing Justice. Melanie also competed on Nebraska’s trial team. Prior to law school Melanie graduated Cum Laude with University Honors from the University of Northern Iowa with a bachelor’s degree in biology.

Adam Kolb served as a Judicial Law Clerk for the Honorable Christian Sande in the Fourth Judicial District of Minnesota. Adam earned his Juris Doctor degree from the University of Minnesota Law School in 2024. During law school, Adam was a certified student attorney for the Civil Rights Appellate Clinic as well as a staff member and managing editor for Minnesota Law Review. Adam also completed a fellowship with the Minnesota Council of Nonprofits, an externship with the Honorable Carolina Lamas in the Fourth Judicial District of Minnesota, and clerkships with the National Housing Law Project and the Housing Justice Center.

Gustafson Gluek is excited to welcome these attorneys to the Firm, and we look forward to what they both will bring to the Gustafson Gluek team!

Gustafson Gluek is pleased to announce that Bailey Twyman-Metzger and Mary Nikolai have been promoted to partner effective January 1, 2026.

Bailey Twyman-Metzger

Since joining Gustafson Gluek in 2023, Bailey has made significant contributions to our antitrust, consumer protection, and complex data breach practice areas. Bailey is a key member of the antitrust team in In re DPP Beef Litigation, where the firm serves as one of four co-leads and has already secured a $52.5 million settlement. She has also been instrumental in In re Fragrances Indirect Purchaser Antitrust Litigation and 3M Combat Ear Plugs Litigation. Bailey has been named a North Star Lawyer for providing over 50 hours of pro bono legal services in a year. She has also been recognized as a Minnesota Lawyer Up-and-Coming Attorney(2025), which honors a select group of lawyers in their first decade of practice who are making a significant impact within their organizations and communities.

Mary Nikolai

Mary has been a vital part of Gustafson Gluek since 2019, making contributions to consumer protection, product defects, and data privacy cases. Mary has played a critical role in the In re: Change Healthcare, Inc. Customer Data Security Breach Litigation, where Gustafson Gluek has been appointed Overall Lead Counsel. Mary also represented and ultimately assisted in the settlement of several former members of the nationwide FLSA collective action alleging off-the-clock work in arbitrations throughout the country. Turner et al v. Chipotle Mexican Grill, Inc. (D. Colo.) Mary has been recognized as a “Rising Star” in Minnesota for 2025 by Super Lawyers. She has also been recognized as a North Star Lawyer for providing over 50 hours of pro bono legal services in a year. Mary’s dedication extends to impactful pro bono work; she was honored as a Minnesota Attorney of the Year in 2022 for her excellent work in a Federal Tort Claims Act case against the Veterans Affairs Medical Center.

Approximately 30 million workers in the United States are subject to non-compete agreements. Non-competes are the antithesis of the American Dream. The American Dream is built on entrepreneurship and the ability for individuals to work hard, innovate, and improve their economic position. Non-competes suppress wages, restrict worker mobility, hinder innovation, and discourage entrepreneurship – harming not only the individuals subject to non-competes, but the economy as a whole.

On November 18, 2025, Gustafson Gluek attorney Abou Amara will speak on a panel at a Continuing Legal Education (CLE) program hosted by the Minnesota State Bar Association (MSBA). This CLE presentation, titled “Federal Rule of Civil Procedure 16.1: Essentials for Antitrust MDL Litigators,” will explore the newly adopted Rule 16.1 of the Federal Rules of Civil Procedure, and its potential impact on case management in the multidistrict and antitrust class action litigation context. The Federal Judiciary’s Committee on Rules of Practice & Procedure gave final approval for the new Rule in 2024, with the new Rule to take effect in December 2025.

Abou Amara, along with U.S. District Court Senior Judge John R. Tunheim, and antitrust defense attorney Davida Williams, will break down the mechanics of Rule 16.1, how it interacts with Rule 23, and give perspectives on how to approach courts as they engage with the Rule for the first time.

Case Update: On July 31, 2025, U.S. District Judge Thomas M. Durkin (N. D. Ill.) granted final approval of a $41.25 million settlement in the Broiler Chicken Antitrust Litigation. This is the second round of settlements secured on behalf of the restaurant class, which brings the total class recovery to over $140 million.

The Commercial and Institutional Indirect Purchaser Class is represented by Gustafson Gluek, led by GG attorneys Daniel E. Gustafson, Daniel C. Hedlund, Joshua R. Rissman, and Tony Stauber, as well as Co-Lead Counsel.

The case is In re Broiler Antitrust Litigation, Case No. 1:16-cv-08637 in the Northern District of Illinois.
