The Attorney General’s Office "encourages Minnesotans to share stories of what they themselves have personally experienced or witnessed due to the presence of DHS — including Immigrations and Customs Enforcement (ICE) and Customs and Border Protection (CBP) — or stories of what people they are close to and in direct contact with have experienced."

This form is "for reporting incidents or effects related to or caused by recent federal actions in Minnesota, including but not limited to: violations of constitutional rights (racial profiling, excessive force, retaliation against protestors, observers, and media), business closures, reduced healthcare access, reduced education access, other issues impacting public safety and civil liberties, federal funding cuts, federal grant terminations, terms and conditions tied to federal program participation, other administrative actions by Federal agencies.

We are angered and devastated by the events this week, including the murder of a woman during a federal ICE operation in Minneapolis.

We are also heartbroken for our hardworking, kindhearted clients and community members who are being terrorized by this occupation.

For our clients and immigrant community, please note:

• An employment authorization document (work permit) alone will no longer protect you from ICE detention.
• A Social Security number will not protect you from ICE detention.
• A deferred action grant will no longer protect you from ICE detention.
• A pending immigration application will not protect you from ICE detention.
• Having no criminal history will not protect you from ICE detention.
• Long-term residence in Minnesota or the United States will not protect you.
• Having a U.S. citizen spouse or U.S. citizen children will not protect you from ICE detention.

This week, we have spoken to countless heartbroken family members who are unable to locate their loved ones — days after they were taken by ICE. Paperwork, family ties, and humanity are being ignored.

The point is cruelty.

Under this continued ICE occupation, Minnesota is not safe for immigrants — and this level of unchecked enforcement makes it dangerous for all Minnesota residents.

For those who seek to support our immigrant community members during this time, please see this list of resources:

It’s difficult to get people to show up for court when they fear being detained by ICE and deported. This reality effectively denies them the ability to exercise their legal rights. The presumption of innocence has become meaningless for many, as not everyone is afforded the basic right to defend themselves in court when facing criminal charges.

One would think that someone with extensive experience in both criminal and civil courts would appreciate the fundamental right to a fair defense.

For many, the threat of deportation means being torn away from their U.S. citizen children who depend on them for both care and financial support. These individuals would also leave behind jobs they worked tirelessly to maintain—jobs that won’t easily be filled. Many of my clients juggle multiple jobs to provide for their families here and abroad.

ICE agents arrested immigrants at the Hennepin County courthouse as part of President Donald Trump’s deportation policies.

Having certified and skilled interpreters in our courts is essential. The interpreter compensation system and new changes are an insult. These interpreters are the only way for most of our clients to have access to the justice system and to be treated fairly. I have seen what happens when interpreters aren't qualified and it's not pretty. Please support our amazing court interpreters.

The interpreters sent a letter to State Court Administrator Jeff Shorba saying that a new compensation policy is "entirely unacceptable."

Davis and Egberg PLLC

Attorneys Lucy Egberg and Erica Davis have over sixteen years of combined experience handling all levels of criminal and immigration matters. Their areas of practice frequently overlap in what we like to call the “crimmigration” sphere. Although they handle cases that are solely criminal and cases that are solely immigration, they often work collaboratively on cases involving both areas of law. Any non-citizen charged with a criminal offense could be at risk of losing their status, being denied future immigration benefits, or being deported. It is extremely important that anyone charged with a criminal offense have competent and aggressive representation from the beginning of the case. If the person charged with a crime is not a U.S. citizen, it is even more important that he or she have good representation by a firm that is knowledgeable in both immigration and criminal law.
