10 YEARS. THANK YOU.

This August marks a milestone that means a great deal to us: 10 years of Lundgren & Johnson, PSC.

When we founded our firm in August 2016, we set out to build a criminal defense practice centered on hard work, careful preparation, personal attention, and a commitment to standing beside people when they need an advocate most.

Ten years later, we are enormously grateful for what that decision became.

We are grateful to the clients and families who have trusted us during some of the most difficult and uncertain moments of their lives.

We are grateful to the attorneys, colleagues, friends, and professionals who have placed their confidence in us by referring people to our firm.

We are grateful for the judges, lawyers, investigators, experts, court staff, and countless others we have had the privilege of working alongside throughout Minnesota.

Over the past decade, we have handled cases throughout Minnesota, stood beside clients in courtrooms across the state, celebrated victories, weathered difficult moments, and had the privilege of helping people move forward with their lives.

A lot has changed since August 2016. Our commitment to the people who place their trust in us has not.

To everyone who has been part of the first ten years of Lundgren & Johnson: THANK YOU!

Today in Olmsted County District Court in Rochester, Dave represented a client at sentencing following a second-degree assault conviction. The presumptive sentence called for a 21-month prison commitment and carried a mandatory minimum prison sentence, although the law allows for some exceptions to the mandatory minimum sentence.

Dave moved for a dispositional departure, seeking probation instead of the presumptive prison sentence. The bar for dispositional departures is high. Still, the court granted the motion and placed our client on probation.

Sentencing is often where a person’s story matters most and today was one of those days.

On the drive back to Minneapolis, Dave stopped at John Burch Park in Cannon Falls, a classic Minnesota town-ball field that’s been a community landmark since the 1930’s, home to generations of Bombers, Bears, and Legion ball. A place built and renewed by community energy.

The stop at the ball field felt like a good reminder that the work we do and the communities we return to are connected in more ways than one.

This Fourth of July, we honor the courage of those who fought for the idea that freedom is not granted to us by the government. It belongs to the people and has always belonged to us.

But our freedom has to be nurtured and zealously protected because it's not guaranteed. These principles are at the heart of criminal defense.

The rights protected in our Constitution were not placed there for easy cases or popular causes. They were written for moments when the power of the government is brought against an individual under contentious circumstances.

Our freedoms were reserved for the people to ensure that no person can be searched without justification, accused without proof, convicted without due process, or punished without fairness.

The presumption of innocence, right to remain silent, requirement that the government prove its case beyond a reasonable doubt to the satisfaction of a unanimous jury populated by members of the community, and every challenge to unlawful government action reflects the same ideals our nation was built upon: liberty, accountability, and the rule of law.

The power of our freedom is found within the collective individuals of our nation, not a centralized or concentrated source. Every one of us deserves equal protection under the law, irrespective of the particulars of our makeup.

This Independence Day, we celebrate not only the flag, but the freedoms it represents. And we celebrate our weighty responsibility to continue to defend those freedoms. Criminal defense is not separate from patriotism. It is one of its clearest expressions.

Minnesota’s Supreme Court issued an important decision on geofence warrants and digital privacy in April 2026.

In State v. Contreras-Sanchez, the Court did not ban geofence warrants outright. But it did hold that people have a reasonable expectation of privacy in Google-stored cell-phone location data under the Minnesota Constitution.

The key issue was particularity. The warrant allowed law enforcement to decide, without further judicial review, which anonymous device IDs should be subjected to a broader search for more location information. The Supreme Court concluded that gave police too much unchecked discretion.

For criminal defense lawyers, this decision matters. Geofence warrants remain available in Minnesota, but privacy, particularity, and officer discretion will now define the fight.

*Memory Lane* (from Adam)

I stumbled across an old email today - from about eight years ago - from a prosecutor who had charged my client with a felony drug offense for possessing ma*****na in his car. The offer was as follows:

"State’s offer on this matter is that Defendant plead guilty to the sole count, and agree to be sentenced to a stay of ex*****on of the presumptive sentence (12+1), and 60 days in the workhouse, standard drug probation for a period of 3 years."

If the offer was accepted, my client would have served a significant period of time in local confinement, and would have been a convicted felon for the remainder of his life. He rejected the State's offer, and we challenged the officer's basis for the stop of his car. And we won. But not only that, the judge ruled from the bench, suppressing evidence and dismissing the case right then and there.

Outside the courtroom, my client - who was much larger than me - picked me up off the ground and hugged me. I didn't have time to react. I just went with it.

Behind every file number is a person whose life can be permanently altered by the outcome of a case. The law is demanding, and the responsibility is immense, but there are few professions that offer the opportunity to stand beside another human being at one of the most consequential moments of their life and, sometimes, help change its course.

A fickle weather day in Minneapolis turned into a lovely evening. I had to stop and snap these pictures of the city from the parking garage before departing for home to see if my tomato plants survived the hail.

Then I got to thinking how those pictures of the cityscape embody the practice of criminal defense.

A criminal case is rarely as simple as it first appears.

Looking out across this cityscape, it’s easy to focus on the skyline, like the glass towers, the church bell tower, the streets below, the clouds overhead. But the longer you look, the more details emerge.

There are sharp contrasts in texture and material: reflective glass, weathered brick, concrete, steel, stone, pavement, and greenery. There are areas flooded with light and others hidden in shadow. There are dozens of separate objects competing for attention. Buildings, streets, signs, vehicles, clouds, flags, windows, and architectural details, each contributing something to the overall story.

Criminal defense is much the same.

Every case arrives with a collection of facts, witnesses, documents, recordings, timelines, assumptions, and unanswered questions. Some facts stand in bright sunlight. Others remain hidden in the shadows. And yet others straddle both, much like the pillar to the right of the bell tower in the attached photos.

Some details appear important at first glance, while others seem insignificant until examined more closely.

At first, the bell tower appears to be the focal point. Then your eye is drawn to the American flag tucked between the buildings. Zoom in further and another detail emerges: a ladder inside the bell tower. Suddenly, the tower is no longer just an architectural feature. It tells a different story. Someone had to design it. Someone had to maintain it. And at some point, some brave person had to climb that ladder to reach the bells above.

One new detail changes how we view the entire scene.

That is exactly what experienced criminal defense lawyers do. We look beyond the obvious. We examine evidence from multiple perspectives. We zoom out to understand the full picture and zoom in to uncover the details others may have overlooked. We ask why a witness remembers an event a certain way, what a video does not show, what context is missing from a report, and whether a seemingly minor fact changes the meaning of everything around it.

The strongest defenses are not built from a single fact. They are built by understanding how every piece fits together.

Just as this cityscape becomes richer and more complex the longer you study it, every criminal case contains layers of information that deserve careful examination. Our job is to see the whole picture, identify the overlooked details, and build the most compelling and comprehensive narrative possible in support of our client’s defense.

Because sometimes the difference between a simple story and the truth is found in the details that most people never notice.
