***$20,000 in Past-Due Benefits Recovered from CIGNA for East Coast Worker***

Operana Law Office was recently successful in obtaining nearly $20,000 in past-due back benefits for an east coast client. Bill, who resides in Washington D.C., worked as a machine operator and had a history of hip pain, high blood pressure, diabetes, chronic kidney disease, and peripheral neuropathy of the legs. He eventually underwent surgery and had hip replacements done in both the left and right hips. Unfortunately, after months of recovery, physical therapy, and pain management, he never fully recovered and had to file for disability.

CIGNA initially approved his claim and found that he was no longer able to perform the duties of his own occupation. However, after a period of time, CIGNA alleged that his condition improved and that he was able to return to a less demanding job in another occupation. Despite his doctor’s restrictions, CIGNA denied Bill’s claim for ongoing LTD benefits.

Bill reached out to us for assistance in appealing CIGNA’s denial. Upon reviewing his file and appealing his case, we argued that CIGNA’s doctors ignored certain pieces of the medical evidence and failed to consider all of his symptoms, restrictions and limitations. We also recommended that he undergo a Nerve Conduction Study to further demonstrate the effects of his neuropathy and leg pain. Finally, we reached out to his own doctor and obtained an opinion contesting the findings of CIGNA’s doctor.

Upon reviewing all of the supportive information we provided, CIGNA overturned its decision and reinstated payment of Bill’s long-term disability benefits, awarding him nearly $20,000 in past-due benefits as well as future ongoing benefits.

**Washington Claimant Awarded Over $20,000 in Benefits from CIGNA**

Operana Law Office was recently successful in assisting a Washington area resident in her long-term disability claim against CIGNA. Carly, who worked for a large corporation for over 15 years, suffered a work-related back injury. In addition to seeking workers’ compensation benefits, she also applied for LTD benefits through her employer’s insurer, CIGNA.

*Medtronic Employee Successful in Long-Term Disability and Social Security Claims*

Attorney Brandon Operana recently assisted a client who was denied long-term disability benefits through her insurer, Reliance Standard.

Mary worked as an inspector for Medtronic for nearly 20 years. Upon ending her shift and leaving work, she slipped and fell, suffering a significant back injury. Despite weeks of conservative treatment that consisted of medications, injections and physical therapy, she developed chronic pain and weakness in the limbs due to pinched nerves in her spine. Her doctor placed her off of work and she applied for long-term disability benefits. In reviewing her claim, Reliance Standard denied her benefits and alleged that she was still able to perform the duties of her job. Reliance Standard even sent her for an independent medical examination (IME) with their own doctor to further support its denial of benefits.

Following Reliance Standard’s decision to deny, we filed a lawsuit against the insurer, claiming that they denied her claim in bad faith, ignored medical evidence, and failed to conduct a full and fair review of her claim. Soon after filing suit, the parties were able to reach an amicable resolution and settled before going to trial.

At the same time, Operana Law assisted Mary with filing an application for Social Security Disability benefits. Within just a few short months of applying, the Social Security Administration approved her claim, awarding her thousands of dollars in past-due benefits.

**Nearly $50,000 in Benefits Recovered from The Standard and United Health Group**

Attorney Brandon Operana was recently successful in obtaining a nearly $50,000 recovery for a client in Texas. The employee worked for United Healthcare and suffered from a history of chronic back pain, depression, anxiety, and Multiple Sclerosis. Although her conditions had existed for a number of years, her symptoms became progressively worse over time, causing her to experience significant physical impairments and cognitive deficits.

Upon applying for long-term disability benefits on her own, The Standard denied her claim and alleged that her conditions were non-severe and that she was able to return to work in her own occupation. She then sought our assistance for her appeal.

To support her claim, we obtained detailed narrative reports and medical opinions from her physicians and also referred her for independent Neuropsychological Testing - to further assess the extent of her cognitive impairments. With this information, we argued to The Standard that she would be incapable of ever returning to her job at United Healthcare. The Standard agreed and ultimately approved her LTD benefits, paying nearly $50,000 in back benefits, as well as ongoing future benefits.
