MA*****NA LEGAL IN MINNESOTA - WILL THERE BE MORE CAR ACCIDENTS?

Minnesota has legalized ma*****na for recreational use. (Although, the law has not taken effect yet.) We are the 23rd state to do so. There are many good reasons to legalize ma*****na. However, does this create new dangers on the road?

Our car accident lawyers frequently handle drunk driving cases. Oftentimes, these are the most tragic and frustrating cases we handle. It is just senseless when an impaired person gets behind the wheel. They are a danger to themselves and others.

Of course, alcohol has been the most common cause of impaired driving accidents. However, our lawyers also handle cases involving drivers impaired with other substances. Therefore, we are concerned that ma*****na impairment will now become more common.

The new law provides $15 million to fund drug recognition training for law enforcement. The MN Public Safety Commissioner will also study an oral roadside test to detect cannabis impairment. There will also be a study to determine how many crashes involve driving while using ma*****na. New laws may be required. For example, like open container laws, driving while smoking pot will be illegal.

It is a good thing that the state is taking these precautions. At this point, there is no reason to believe ma*****na is more of a threat to drivers than alcohol. However, anything that impairs a driver's ability is an obvious risk to everyone. Therefore, it must be taken seriously.

SERIOUS CAR CRASHES INCREASED DURING COVID
A recent article in the Star Tribune reported that car accident serious injuries increased during COVID. Our car accident lawyers have noticed this. Fatalities have also increased. Here is an excerpt of the article:

Roads in the Twin Cities metro area became far more dangerous after the onset of the COVID-19 pandemic. Motorists drove faster, eschewed seat belts and got behind the wheel while impaired by alcohol or drugs, according to newly released state data.

Crashes resulting in serious injury or death spiked between 2020 and 2022. This effectively erased a decade of steady declines. Traffic deaths statewide hit 488 in 2021 and 446 last year, after five straight years below 400. In the same period, crashes that left people seriously injured jumped from 696 to 951, a 36% increase, according to the state data. RESTITUTION AFTER BEING INJURED IN AN ACCIDENT
Some car accident cases involve criminal charges. For example, the driver may be driving without a license or insurance. Likewise, a driver could be drunk or driving recklessly. Those types of cases result in criminal charges against the other driver. Therefore, at some point, the victim will get a form in the mail asking about restitution. Our car accident lawyers see this regularly.

What is restitution? Restitution is (1) payment of compensation to the victim or the victim’s family; and (2) if the victim is deceased or already has been fully compensated, payment of money to a victim assistance program or other program directed by the court. Restitution may include any out-of-pocket losses resulting from the crime. For example, medical and therapy costs, replacement of wages and services. Of course, restitution is not limited to injury cases. For example, there may be restitution in property damage cases and other situations. ATV SAFETY FOR CHILDREN

Our lawyers handle cases where a child is injured in an ATV accident. The ATV child injury cases we have handed so far have not been life-threatening. However, that has just been luck. A broken arm could easily have been a broken neck.

Soon, many people in Minnesota will be opening up their cabins. It is worth at least thinking about ATV safety and children. If you allow your child to drive an ATV, the two most important safety measures are training and a helmet. A child should not be allowed to drive an ATV until they are ready. This means waiting until they are old enough, and then only driving with an adult until they demonstrate ability and safety.

A recent American Academy of Pediatrics article notes that more children die each year on ATVs than in bicycle crashes. The highest proportion of ATV accidents where a child is injured are to boys between the ages of 12 and 15. However, our lawyers have also represented several girls injured in an ATV accident. CAN YOU STILL SUE OTHER DRIVER IF YOU DON’T HAVE CAR INSURANCE?
Driving without insurance is risky. You will have no protection if you cause an accident. You may damage or total your car and not be able to recover anything for it. Even worse, you may damage someone else’s car or injure them. They or their insurance can then sue you and you will have to pay it yourself. But what if you don’t have car insurance and the other driver is at fault? Even if you were not at fault, there are some consequences if you were in an accident without auto insurance. First, you may get a ticket for driving without insurance. Furthermore, complications may arise if the other driver disputes being at fault. In such a scenario, you won’t receive prompt payment to repair or replace your car. Additionally, if you sustained injuries in the crash, you won’t receive No-Fault coverage for your medical bills and wage loss.

Having said all that, you CAN still sue the other driver who caused the accident. If the other car was at fault, their insurance is responsible for your car damage, medical bills, and more. They cannot hold against you that you did not have your own auto insurance. In fact, if there was a trial, the jury would never even be told about your lack of insurance.
