Our client successfully worked as an electrician for more than twenty years before he was diagnosed with a seizure disorder. Even after multiple doctors cleared our client to return to work, Norfolk Southern refused to allow him to work and kept moving the goal posts, changing its criteria. This week a Court agreed and denied Norfolk Southern's motion for summary judgment. We look forward to presenting our full case to a jury.

After learning that another train he was assigned to inspect had not been tied down, our client recorded a video of the train. Rather than thank our client for being conscientious, our client was removed from service without pay and ordered to submit to a drug test. After our client confronted his manager upon learning that the manager intended to misreport an accident, our client was threatened with termination unless he abided. Our client refused to misreport the accident and stepped down from management. Two weeks later, he was fired. We are suing Road & Rail for retaliation under the Federal Rail Safety Act.
