ON TRIAL - first jury trial after covid shutdown 🥳

Think about how desperate a politician must be for votes if they are framing their opponent as for "violent criminals roaming the streets" to hurt people. Imagine leaders inspired and didn't use fear as the primary emotion to tap into for their political future. The truth is the majority of voters in NY have no idea how cash bail works (or how the preselected judges on the ballot who set bail works but that's a whole other topic) and those using fear are relying on your lack of knowledge on this topic, because of course it is easy to fear things we don't know or understand. I can guarantee you most (if not all) of the politicians running these types of ads have never attended a criminal arraignment where bail is utilized.

If someone commits a violent r**e or lets say a "mugging" with a weapon and serious injury results and let's sail bail is set at $500,000 dollars on the person arrested for that crime at the arraignment. If that person has a friend or family member walk in with $500,000 cash or utilizes a bail bond agent to post less than the full amount, that "violent" criminal who is facing the allegations walks right out of jail and back on the street. So you see, money controls who is on the street even under the "scary new" bail law. Now, always, and likely forever. what is really on the ballot is the presumption of innocence and capitalism....2 concepts that do not operate in tandem in our system.

I didn't see any political outrage when economically disenfranchised people (who are presumed innocent) remain incarcerated for months and months because they cannot afford the often times egregious bail that was set by judges on low level offenses on people with no criminal backgrounds. I have seen it happen time and time again where defendants due to economics and incompetent lawyers end up pleading guilty to a crime in order to get out of jail, and then the cycle of crime and poverty continues.

The bail law has not made you unsafe. Lack of resources to correct systematic poverty in urban areas and lack of mental health funding has made you feel unsafe.

"In our system of justice it is better to be rich and guilty than poor and innocent" - Bryan Stevenson

client charged with a crime in December 2019....and still writing motions.

Submitted a motion today to New York County (Manhattan) prosecutors who argued against a client's application for sealing of a criminal record. Did you know New York passed a relatively new law which allows for sealing of certain (most) criminal convictions after 10 years? Reach out if you have any questions.

Client charged with DWI in Nassau County…so of course no plea offer, must plead guilty to the misdemeanor crime or go to trial. Client hired Mary to handle case. Yesterday, after filing a motion ALL charges completely dismissed, due to an unexplained police / prosecutor delay causing a delayed arraignment despite client appearing in court for months ready to proceed.

Client's Assault case dismissed today after just a few short court dates and a motion. A pro-Trumper and an anti-Trumper came to blows in this case. It's sad that the divisive rhetoric that consumes propaganda networks has spilled over into the streets. I have SEVERAL cases like this, so yes, in case you had any doubt rhetoric has led to violence. As we approach the anniversary of Jan. 6th I ask you to think very carefully about what / how much media you consume. Opposite sides should discuss ideas...those disagreements are fair. Does your media discuss ideas and policy or is the other party labeled a "nasty" woman or excessively focused on tarnishing an individual of the opposite political party?

ENORMOUS victory for a client today. Cleared of all wrongdoing involving allegations of sexual assault on a college campus. One allegation completely halted all life plans for this very accomplished young man. Utilizing the former (not current) Title IX regulations precluded attorney cross examination at the hearing. Doesn't mean we weren't prepared.... client conducted cross lasted hours and revealed multiple inconsistencies and lies on the way to ensuring client's name was cleared. Such an honor to be hired by this family. Good to be preparing litigation again after covid shutdown!

Today I watched my client, a young African-American man in his early 20s, get sentenced to probation on a felony conviction instead of the 2+ years of incarceration he was facing. Last night, he became a father as his girlfriend gave birth to their first child. A fact I knew as I was advocating very strongly for him. Instead of walking into jail he was able to return to the hospital and be with his girlfriend (who just had a C-section) and their beautiful new daughter. I was able to congratulate him and his father (first time grandparent) in my office today and I will sleep so soundly knowing that families are together. His dad hired me after arraignment because he thought I may know what I am doing in a courtroom. This young man has 2 degrees, made a silly mistake, and just wanted to be able to continue bettering himself and be there for his family. I am so happy for them, everyone deserves a second chance. No matter what you do, never give up!

After months of negotiation and persistence was able to secure a sentence of straight probation for a client. Initially, over a year of incarceration was the option presented. If you want a lawyer who gives up, hire someone else!

We are NY tough. Stay safe and wear a (Mets) mask. Looking forward to going to court next week for a client. As always the incredible court staff and administration are working tirelessly to keep us safe. Despite the potential for physical and/or health issues, I have never in my entire career felt unsafe in any courtroom thanks to the outstanding dedication of our court officers.
