Post 5: A Will Doesn’t Transfer Assets by Itself

A Will explains where you want assets to go—but it does not transfer them.

Before any assets can be distributed to a named beneficiary, the court must appoint the Personal Representative, who is usually the person named in the Will, unless that person is not qualified.

This appointment can only be made by the Probate court, and starting a Probate is the way that the appointment is made.

The Personal Representative then has the authority to act on behalf of the estate; however, many rules and procedures must be followed before distributing the estate assets.

Post 4: Healthcare Decisions Require Separate Planning

A Will does not and cannot allow anyone to make healthcare decisions for you.

Only a properly executed Health Care Power of Attorney gives someone the legal authority to make medical decisions if you’re unable to do so yourself.

A Will has no legal effect during your lifetime.

If you become incapacitated and don’t have a Financial Power of Attorney, a court-ordered guardianship may be required—even if you are married.

There is no automatic authority for a spouse to act without proper legal documents.
