Last week, Chesapeake Wills & Trusts rented out the entire Libations Restaurant in Millersville for the evening to host our annual members-only Care Plan Dinner. As usual, attendees enjoyed good food and camaraderie at the packed event.

Highlights of the evening included CWT founder Greg Jimeno making a presentation to update members about recent changes in the law and firm news, and to discuss the Medicaid application process.

Greg also announced the publication of the second edition of his book, “How to Protect Your Home and Life Savings in Maryland.” Members were provided with free copies of the book at the book signing held later in the evening.

Chesapeake Wills & Trusts takes its obligation to Care Plan members very seriously. As a small part of that, we host this dinner annually in order to further educate our members, foster an ongoing relationship, and keep you prepared by updating you about important news.

If you are paying child support and alimony following a divorce, you may be wondering if a court might order the amounts reduced if you remarry. Let’s address each of these individually.

💵 Alimony
If the person receiving alimony remarries, that is usually the end of alimony they will receive in the state of Maryland (barring a prior agreement to the contrary).

The same cannot be said when the person paying alimony remarries. That on its own is not a basis for reducing alimony. However, if you as the payor can show a substantial change in your financial circumstances, the court may consider a reduction.

💵 Child Support
If the child support payor remarries, it is not automatically going to affect the amount they pay for child support. The child support calculation is based on the parents’ income without regard to the income of their spouses. However, as with alimony, if they can show a significant downward change in their finances, that could potentially be grounds to request a modification.

Be aware that if the payor has another child in their home that they have a legal duty to support (perhaps remarries and has another child or adopts one), that child stays with them at least 92 nights out of the year, and there is no existing court order to support the child, the payor qualifies to petition the court to reduce the child support of the first child.

When you buy a house in Maryland with a spouse, there are family law processes in place for how to handle the house in case of divorce. But what if you buy a house together when you aren’t married?

Instead of being handled under marital property rules in family court, splitting the jointly-titled house must be handled as a regular property dispute between co-owners if you are not married. Here are the options.

✅ Buy-Out
The parties can agree that one party will buy out the other. You will need to have the property appraised, or agree upon the value and the equity calculated. The partner who keeps the house pays the other their share, and they refinance the mortgage so the loan is only in their name.

✅ Voluntary Sale
The partners can agree to sell the house and split the proceeds after the mortgage and any fees are paid.

✅ One Partner Stays Temporarily
Sometimes partners agree that one person will remain in the home for a set period of time before buying out the other or selling the property. If you want this type of agreement, have your attorney draw up an agreement.

✅ Court-Ordered Sale
If you and your partner do not agree about what to do with the house, you can petition a Maryland court to resolve the issue through a sale in lieu of partition. The court will appoint a trustee to sell your house, and the court will determine how to distribute the proceeds. You can file this action without agreement from your partner and force a sale.

It’s probably no surprise to learn that how long your Maryland divorce will take depends on many factors.

👉 Do you both agree on all issues? If you agree on all issues including property division, property valuation, child custody, child support and alimony, your divorce may be finalized in two to four months after the other spouse files their answer (depending on the court’s schedule).

👉 If you don’t agree on all important issues, then your divorce is contested. This is going to add time, taking perhaps 12 to 18 months or even longer.

👉 substantial assets involved? The higher value your assets, the longer your divorce is likely to take. You may have to call in experts that are unnecessary in lower property value divorces.

👉 Do you have children? If the parents don’t agree regarding child support and child custody, and even if they do, it can take the court some time to review all evidence necessary to make a decision in the best interests of the children.

👉 Where do you live? Some courts are just much busier than others.

Basic child support in Maryland doesn’t always cover everything a child needs, especially when there are major medical or educational expenses.

Maryland law calls these “uninsured extraordinary medical expenses,” and they can be added on top of regular child support.

Examples may include:
✅ Braces or orthodontics
✅ Counseling or therapy
✅ Private school tuition
✅ Tutoring or learning support
✅ Special needs care or services
✅ High medical bills not covered by insurance

Who pays? The court may:
✔ Divide the costs between parents
✔ Order reimbursement if one parent already paid
✔ Modify support if the expenses are ongoing

You do NOT have to shoulder these costs alone. If your child has significant medical or educational needs, Maryland law may require the other parent to help pay for them.
