Estate planning is not only about distributing assets. It is also about ensuring your loved ones are well-positioned and protected. Taking proactive steps now can help create clarity and reduce complications during a challenging time.

There are several important steps that can help safeguard your family and your estate:

🔹 Creating or updating a will that clearly directs how estate assets should be used to satisfy outstanding debts.
🔹 Establishing appropriate trusts to help safeguard certain assets.
🔹 Reviewing beneficiary designations on life insurance and retirement accounts, which may allow certain assets to pass outside of probate and avoid being used to satisfy estate debts, depending on state law.
🔹 Evaluating and reducing high-interest or unsecured debt during your lifetime.

Thoughtful planning today can provide stability and peace of mind tomorrow. If you would like to review your estate plan or discuss strategies to protect your loved ones, contact us to schedule a consultation.

Protecting Our Seniors: Highlights from Older Michiganians Day 2026 💙

At Malicoat Law, PLC, here in Midland, we believe that safeguarding the rights and well-being of our senior community is one of our most vital responsibilities. That is why we are closely following statewide updates from last week's Older Michiganians Day.

Michigan Attorney General Dana Nessel issued a critical reminder to seniors and their families regarding the rising threat of elder abuse and financial exploitation. Shockingly, state data shows that over 100,000 older adults in Michigan fall victim to neglect, fraud, or exploitation every single year.

Fortunately, action is being taken. The Michigan Elder Abuse Task Force highlighted several bipartisan bills moving through Lansing aimed at increasing consumer protection and transparency for our seniors. These include:

🔹 Requiring independent appraisals before selling the home of an adult under guardianship to ensure fair market value.
🔹 Guaranteeing an individual's right to an attorney during guardianship hearings.
🔹 Establishing "Surrogate Consent" laws to allow trusted individuals to make healthcare decisions if a formal advocate isn't already named.

These updates underscore a crucial truth: protecting your legacy and autonomy requires proactive legal planning. Waiting until an emergency occurs can leave seniors vulnerable to scammers or stressful court interventions.

Whether you need to establish a robust Power of Attorney, update your estate plan, or navigate guardianship options, Malicoat Law, PLC is here to guide your family.

With National Senior Fraud Awareness Day on May 15th, we wanted to reach out to go over several common scams making the rounds so you can quickly identify potential scam messages.

✅ Tech Support Scams - Fraudsters impersonate reputable tech support representatives and claim there is a problem with your device. They seek remote access or payment to "fix" issues that don't exist.

✅ Government or Medicare Impersonation - Scammers pose as representatives from Medicare, the Social Security Administration, or other agencies to collect personal information or payments. Real agencies do not solicit such data by unsolicited calls, texts, or emails.

✅ Family Imposter Scams - Criminals pretend to be a loved one in distress and pressure you to send money immediately.

✅ Sweepstakes, Lottery, and Prize Scams - You are told that you have won money but must pay fees to collect your "winnings."

✅ Romance or Investment Scams - Scammers build emotional trust online, then exploit it for financial gain.

We hope these tips are helpful as we all navigate an increasingly online world. As always, if you have questions or need guidance within our area of expertise, do not hesitate to reach out. We are here to help.

May is Older Americans Month, and to honor the month, I wanted to take a moment to share a few key areas where our team can help to ensure your estate plan meets your needs as you and your family get older.

📋 Living trusts help ensure your assets are distributed according to your wishes while potentially avoiding probate. Unlike a will, a trust can take effect during your lifetime and allow for seamless asset management if you become incapacitated.

📋 Powers of attorney authorize trusted individuals to make decisions on your behalf if you're unable to do so yourself, preventing delays, confusion, or court intervention. You can designate different powers of attorney for different concerns — such as health care or financial matters.

📋 Advance health care directives allow you to outline medical treatment preferences and appoint a health care agent to advocate for those wishes if you become incapacitated. These documents work with a health care power of attorney, and it's crucial to ensure they align.

Having these documents in place brings clarity, confidence, and peace of mind. If you have questions about your estate plan or would like to discuss these documents, feel free to reach out.
