🏠 Primary Custody vs. 50/50 Custody in Texas: What’s the Real Difference?

We hear this all the time:

“If we have 50/50 custody, that means no one pays child support… right?”

Not always.

Let’s break it down 👇



⚖️ Primary Custody (Sole Right to Designate Residence)
• One parent decides where the child lives
• The other parent follows a possession schedule (like Standard or Expanded Standard)
• The non-primary parent usually pays child support

➡️ Time split: ~60/40 (but depends on your order)
➡️ Child support: Typically required



🟰 50/50 Custody (Equal Possession Time)
• Parents share equal or nearly equal time
• No parent has the “final say” on where the child lives
• Child support may still be ordered depending on:
• Income differences
• Insurance coverage
• Who pays for extracurriculars, daycare, etc.

➡️ Time split: Equal (alternating weeks, 2-2-3, etc.)
➡️ Child support: Can still apply based on financial fairness



💡 So, what’s the key difference?
Primary custody is about decision-making—not just time.
50/50 custody doesn’t automatically cancel child support.

👨‍👦 Can a Dad Really Get Custody in Texas?

Yes—more than ever before.

Gone are the days when courts automatically favored mothers. In Texas, the law is clear:
👉 There is no preference based on gender.

Instead, the court looks at one thing:
✅ The best interest of the child.

Here’s what gives dads an edge:
• Active involvement – Are you present in school, medical care, extracurriculars?
• Stability & safety – Do you have a consistent home environment?
• Co-parenting mindset – Are you willing to work with the other parent?
• Evidence – Can you show you’ve been a consistent, loving, reliable parent?

In many cases, Texas courts award joint custody (called Joint Managing Conservatorship), and dads can absolutely be named the primary custodial parent.

💡 Don’t assume the odds are against you. Good dads win custody—especially when they’re prepared and persistent.

These two terms often get mixed up—but in Texas, they mean very different things depending on the context.

👶 Conservatorship (Family Law/Custody Cases)

In Texas custody cases, “conservatorship” refers to a parent’s legal rights and responsibilities for a child.
• Joint Managing Conservatorship (JMC): Most common—both parents share rights and duties (not necessarily 50/50 time).
• Sole Managing Conservatorship (SMC): One parent has the majority of the rights and responsibilities.
• Possessory Conservator: The other parent may have visitation but fewer rights.

✅ Used in divorce, custody, and child support cases.



🧓 Guardianship (Probate/Disability Law)

Guardianship refers to court-appointed authority over someone who can’t care for themselves—often a child with no parents or an incapacitated adult.
• Guardian of the Person: Makes decisions about medical care, living arrangements, etc.
• Guardian of the Estate: Manages finances and property.

We hear this one all the time—and the answer is:
Not exactly.

In Texas:

✅ A child age 12 or older can express a preference – But this doesn’t mean they choose. The judge can consider their opinion—but isn’t required to follow it.

✅ It’s just one of many factors – Courts look at school performance, emotional needs, parental stability, and more—not just what the child says.

✅ The request must be made properly – A parent (or the child’s attorney) must request that the judge interview the child in chambers—privately and respectfully.

✅ It’s not a quick fix – Some judges weigh a child’s maturity and whether they’ve been influenced or coached.

💡 Bottom line: The child’s voice matters—but so does everything else.
