Miami Partner Jennifer V. Ruiz and Associate Natalia M. Trabue obtained summary judgment in favor of their clients a condominium association and its property manager in a short-term rental/Air Bnb/VRBO dispute involving seven (7) units within the condominium and allegations of tortious interference with rental business relationships when the association terminated leasing rights due to repeated violations of its rules against one-night stays and excessive occupancy.

The Court dismissed the Plaintiff’s case in its entirety, finding that the association was not a stranger to the leases and its interference was justified, reinforcing the authority of condominium associations to regulate and enforce occupancy restrictions, especially minimum-night stays. Since Defendants served a Proposal for Settlement, they will now seek recovery of their attorneys’ fees and costs from the Plaintiff.
