BankruptcyNow - Bankruptcy Attorney in Miami Financial stress? 😔 We may be able to help. We are a debt relief agency who help people file for Michael J. Mr. Legal assistants assist the lawyers. In 1990, Mr.

Brooks is a bankruptcy lawyer who practices in Miami-Dade County, Broward County and Palm Beach County. The entire Southern District of Florida is covered by his practice. Michael’s main focus is on Chapter 7 and Chapter 13 bankruptcy cases. Brooks has worked on thousands of cases over a 38 year career. The law firm strives to keep their client’s informed about what is happening with their case. C

ommunication is a very important part of the firm’s service to their client’s. Bankruptcy is a fast paced practice, and communication with the client is very important. All of the legal work is performed by the lawyers involved with the practice. They are not bankruptcy lawyers, and our reputation with the Court and our clients are of the utmost importance to the members of the firm. The bankruptcy lawyers are in constant contact with the bankruptcy trustee involved with each individual clients bankruptcy case. Any documentation required by the bankruptcy court that we don’t already have will be requested from the client immediately, and then sent to the trustee. We understand that going through any legal process is filled with stress. We try to make the bankruptcy process as stress free as possible. The client will have no bankruptcy court hearings without having one of our lawyers by their side. The attorney and/or the client will be fully prepared for any bankruptcy court hearings, with or without the client being present. Our goal is to get you out of the bankruptcy process as quickly as possible with as little pressure as possible. Our initial bankruptcy consultation is free. At the consultation, the client will be asked to fill out a small sheet to give the attorney the information necessary to begin the consultation with the client. At that consultation, the client will be informed about both elements of Chapter 7 and Chapter 13 bankruptcy. A recommendation will be given by the attorney consulting the client which bankruptcy to file, but ultimately, it will be the clients decision to choose what’s best for them. At that first bankruptcy consultation, all costs and fees will be discussed, and an affordable payment plan can be arranged so the client can afford the costs and fees to file the bankruptcy. During this time, creditors may be trying to attempt to collect on a credit card debt or other debt. We will also advise the client what to do about more serious matters, like mortgage foreclosure or vehicle repossession issues. We will take calls from creditors to keep them off your back until the bankruptcy is filed. Sometimes the answer to the question of whether or not the client should file for bankruptcy is no. We are in this to do what is right for the client, not what is right for us. There is literally no bankruptcy case that is too complicated for us in Chapter 7 or Chapter 13. Michael Brooks graduated from the University of Florida with a Bachelor of Arts degree in Political Science. He went on to receive his Law Degree from Nova University in 1984. His first job was working in criminal law for the Miami Dade Public Defender. He then went to work for a law firm working on many different cases including personal injury, contracts, probate, drafting wills, real estate transactions, criminal and corporate law. Brooks moved his practice exclusively into the field of bankruptcy. However, his experience in the prior fields of law come in handy when real estate matters or probate maters arise. Also, many clients have tax issues that are complicated. Brooks has experience with working with the IRS in bankruptcy court to resolve even long standing IRS issues. If a client has a corporation, Mr. Brooks can be helpful in explaining how to get rid of the corporate liability without losing the business.

Bankruptcy is a serious step that impacts your financial future significantly. As Miami's trusted bankruptcy attorney, Michael Brooks, I want to provide a bit of guidance on when it might be the right time to consider this path.

A. Unmanageable Debt: If your debts have become unmanageable and you see no viable way to repay them, bankruptcy may be a reasonable option. This can occur when your income is not sufficient to cover your monthly bills, or you're reliant on credit to pay for basic necessities.

B. Asset Protection: If you're at risk of losing important assets, like your home, because of your debts, bankruptcy may provide a way to protect them.

C. Overwhelming Stress: If your financial situation is causing you immense stress and negatively affecting your quality of life, seeking a fresh start through bankruptcy can be a wise step.

D. Legal Action: If creditors are threatening to sue you, or if a lawsuit has already been filed against you, bankruptcy can put an immediate halt to these proceedings.

E. Failed Debt Relief Options: If you've tried other debt relief options such as debt consolidation or negotiation but have not been successful, bankruptcy could be your next course of action.

Filing for bankruptcy is never an easy decision to make, but sometimes it's the best one. Remember, every person's situation is unique. If you're in the Miami area and considering bankruptcy, reach out to me, Michael Brooks, for personalized advice and guidance. Bankruptcy might seem daunting, but it carries some surprising benefits when it comes to saving your home. Here are some enlightening facts:

1. Filing for bankruptcy can temporarily stop foreclosure. The "automatic stay" halts most collection activities, including foreclosure, the moment you file for bankruptcy.
2. Chapter 13 bankruptcy allows you to pay off your mortgage arrears over time, while still keeping your home.
3. If your home's value is less than the total of your liens, Chapter 13 bankruptcy might allow you to "strip" or eliminate your second mortgage.
4. Bankruptcy might help reduce or eliminate other debts, freeing up more income to make your mortgage payments.
5. In some cases, bankruptcy can discharge tax debts, making it easier to afford your mortgage.

Navigating bankruptcy's intricacies might be challenging, but you don't have to do it alone. Michael Brooks, an experienced bankruptcy attorney in Miami, is here to help. With his guidance, you can turn a challenging financial situation into a fresh start 👍🏽

You may be eligible to restructure your mortgage arrears through Chapter 13 bankruptcy, which can provide you with a manageable repayment plan while maintaining your residence.

Chapter 13 bankruptcy often serves as a financial lifeline for individuals who find themselves in a higher income bracket, with valuable assets like a car or a home, and are determined to prevent the repossession of these assets or a home foreclosure due to unresolved debts.

Chapter 13 is likely your sole bankruptcy option if your income is higher than the median for households of your size, an aspect that bars you from passing the means test.

Anyone with a regular income stream can consider filing for Chapter 13 bankruptcy, as long as the accumulated debt falls within the prescribed threshold.

However, certain restrictions apply to prospective filers. For example, an individual is barred from filing under Chapter 13, or any other chapter, if, during the preceding 180 days, a previous bankruptcy petition was dismissed because of the debtor's intentional failure to appear before the court or comply with court orders, or if it was voluntarily dismissed after creditors sought relief from the bankruptcy court to recoup property on which they have liens.

Chapter 13 bankruptcy might prove more beneficial for those who don't qualify for a Chapter 7 filing, perhaps because their income is too high.

Furthermore, it's a viable option for individuals with a steady income who face imminent foreclosure on their home or require additional time to pay off tax or support arrearages.

Attorney Michael Brooks in Miami can provide the legal guidance you need to determine whether Chapter 13 bankruptcy is the best path forward for you. His experience and track record make him a trusted choice for individuals seeking a fresh financial start.
