Martindale-Hubbell (MH) is the gold standard in attorney ratings. This is an incredible video that shows how quickly dangerous weather conditions can form. Really worth watching all the way through. Try to notice just how many people are affected by this relatively confined phenomenon. Sometimes severe weather events like this form and dissipate fast enough that they don't make the news and aren't widely recorded. Despite what your insurer may say, that does not mean they did not happen! We help you get paid everything you are owed in situations like this.

Is your homeowners insurance policy with State Farm? If so, pay attention.

If a storm hits, you may think you have some time to evaluate your damage and decide whether or not to file a claim. Some damage may not even be immediately apparent. So how long do you have? State Farm says 60 days. At least, that's what many of their policies say. Most, if not all, homeowners policies include a condition which requires the insured to submit what is called a Sworn Statement In Proof Of Loss within 60 days of the insurance company's request. The Sworn Proof is essentially a form to be filled out with information about the loss and claim, including how the damage occurred and the total amount of money you are seeking. State Farm is different. In most policies I have seen from them, there is a requirement that the insured submit a Sworn Proof within 60 days of the loss, even without State Farm requesting the Sworn Proof! Florida case law is replete with cases where State Farm claimed they did not have to pay their insured anything at all because this Sworn Proof was either not sent in, or was sent in late.

Unfortunately, this "gotcha" game is all too common. Many times when insureds call us, they have already taken action (or inaction) which has negatively affected their claim. You need an advocate from the beginning who knows the law, who can help you avoid pitfalls, and who can maximize your recovery. Call us any time. We are here to help.

Have you located your homeowners or renters insurance policy yet? Do it now! Your declarations page is going to looks something like the one in the picture. Even if you don't have the full policy, find the declarations page. Found it? Good. Now take a photo of it with your phone and email it to yourself. Then take it, put it in a ziplock bag and keep it somewhere safe. If you need to make a claim, you can use the information on the declarations page to do so. Now that you've done that, take some photos of the outside and inside of your home. Valuable items, furniture, electronics - make sure you have some proof of what you own. Take the photos and email them to yourself. Believe me, this will make your job much easier if these things get damaged and you need to make a claim for them. However, even if you do these things, we strongly urge you to consult a professional when making a claim. Many people try to navigate the claims process alone and end up calling us when they've been strung along for months, seriously underpaid, or have had their claim denied. An attorney or public adjuster can make all the difference in getting a fair payment on your claim.

The most recent EURO and Canadian models bring Irma straight through South Florida. American model keeps it just off shore with the coast seeing major Hurricane force winds.

Here is a photo shared recently showing some effects of Hurricane Andrew, which was not as powerful as Irma currently is. Just a reminder of what these storms can do. If you have a boat, you really need to figure out how to secure it - and quickly.

Thanks to Robert Stephen.

Some of the very latest models have taken a slightly eastward shift. But as we have seen, these models can change drastically between runs. While this should be of note, do not focus too much on this. This is the most powerful storm ever to form in this area of the Atlantic. It will be important to see what Wednesday brings.

At this point we hope that all Floridians are closely monitoring Hurricane Irma. For those of us here in South Florida, we currently have a Category 5 storm bearing down on us. The storm has already broken several records as far as its strength, and it is expected to break several more. Some of you may know that there is not a single computer model predicting the path of the storm. There are many. The two which are probably the most trusted are the GFS and EURO models. There are many other models which are run at frequent intervals. Typically, these models are not in agreement. After all, predicting the motion of a storm more than 48 hours or so out is extremely difficult. So if you ever find the models (especially the GFS and EURO) in agreement, it's important to pay attention.

We know that at this time Irma has sustained winds of 185 mph. This puts it above our old buddy Andrew on the strength-o-meter. The models are very much in agreement as to where the storm will go until about Friday. However, after that there is still significant uncertainty. Most models predict a turn to the North. Some put this turn right into the Southeast coast of Florida, some take it right up the middle, some take it along the West coast. A few keep Irma out just off the East coast of Florida. Even in that scenario, the coast of Florida would still face sustained Hurricane force winds and up to 24 hours of Tropical Storm force winds. At this time, we really don't know where that eye is going to go. But we do know that the eyewall winds are extremely strong. Wherever Irma's eye makes landfall will likely see mass devastation.

If you are in Florida, especially South Florida, you need to take this storm seriously. Monroe County and Miami Beach are already facing mandatory evacuation orders. Whether you evacuate or not, now is the time to plan a safe place to be, secure supplies (a gallon of water per person per day, non-perishable foods, flashlights, gas, cash). It is also the time to secure your insurance policy documents and take photos of your home and personal belongings. You will be very thankful you did if you need to make a claim after the storm.

At Wilson Law Offices, we have assisted hundreds of clients with property damage claims, from inception through jury trial, and have collected millions on their behalf. We are always here to help.
