Here is why you should refer your clients to a real estate attorney to handle closings:

1) Attorneys are better equipped than title companies to resolve title/lien issues that may arise, and to get the deal successfully closed on time and without mistakes.
2) MOST attorneys don't charge more than title companies for closings. This surprises many people, but I see the fees everyday, and in my experience it is true.
3) Building a relationship with an attorney is helpful for other matters that you or your clients may need assistance with, i.e. commission disputes, contract disputes, landlord-tenant issues, HOA issues, estate planning, etc.
4) Attorneys are viewed as more "prestigious". This reason is silly, but I do think it matters to certain clients.
5) Attorneys will better protect your client's interests, whereas a title company does not have the same level of fiduciary obligation.

I've been noticing a lot of home buyers (not represented by me) putting their escrow deposit at risk lately. The most common way I see people lose their deposit is because they aren't approved for their mortgage within the loan contingency period of the contract. This is preventable by requesting an extension from the seller, and if the seller isn't cooperative, you usually still have enough leverage at that point to reach an agreement. Unfortunately, many closers don't take the deadlines seriously, and if the loan contingency period has passed and you don't have approval yet, you are in a dangerous position. Get a real estate attorney from day one so this doesn't happen.

You're looking to buy a home, when should you reach out to a real estate attorney? The answer is when you start making written offers, but worst case scenario, call an attorney once you have a signed contract. You will likely hear that you don't need an attorney and that real estate closings are no big deal. This is false. A home purchase is likely the single biggest financial event of your life, and with that comes liability. Get an attorney and have it handled properly.

What is title insurance? Does anybody really know? The answer is NO, most lawyers don't even know. Basically it insures you are getting good title to the property you purchase, and there are no unresolved mortgages, liens, or other encumbrances to cause an issue down the road. The Supreme Court has decided that the CDC exceeded its authority in continuing the nationwide eviction ban. This was almost certainly the right decision from a legal standpoint, and it will affect many of my clients directly, some positively and some negatively. If Congress decides that a continued eviction ban is in the best interest of the country, they will need to act.

The ruling followed political and legal maneuvering by the administration to retain protections for tenants. It puts hundreds of thousands at risk of being put out of their homes.

Times are tough and many businesses have been forced to breach a lease or other contractual obligations. There are defenses that can be raised, but it remains to be seen how much leeway Judges will give Defendants who businesses have been destroyed by the Pandemic.

Businesses across the world have been impacted by the spread of Covid-19, and many will be unable continue paying rent or performing other contractual obligations. However, such actions may be justified if caused by the global pandemic.
