Had an awesome time nerding out and presenting on EB-2 NIW creative strategies and pitfalls with my talented colleagues, Yadira Aguilar, Esq., Laura dePaz Cabrera, and Andre Linhares Esq., at the 37th Annual Immigration Conference organized by the AILA Central FL Chapter. 😊 No matter how frequently you handle a given case type, there's always something new to learn, and I'm already excited to implement some great bits of advice from my peers into my NIW practice. I'd also like to think that I dished out some good strategic advice myself! Thank you, Rusten Hurd, for the invitation to share my thoughts, and to the AILA Central FL Chapter for being so welcoming. You all put on an excellent conference all around, down from the panel topics to the speaker selection and choice of venue in Clearwater Beach. Made lots of new friends, learned, and relaxed a bit too. Looking forward to next time!

We would like to share several key takeaways from the 23rd annual American Immigration Lawyers Association (AILA) conference which may be useful for other attorneys who didn't make it up to Orlando, as well as for clients interested in general updates:

- The ETA750B form is officially out of use for those dealing with the DOL, as well as for National Interest Waiver practitioners.

- There isn't much anticipated improvement for the EB-2 category retrogression in term of the Visa Bulletin. This means that EB-2 candidates cannot apply for "adjustment of status" inside the U.S., in parallel with their EB-2 case. They must continue to file via the consular process until there is no longer a retrogression.

- USCIS has expanded Premium Processing (meaning, expedited processing) for I-539 Change of Status Applications seeking a switch to F, M, or J nonimmigrant status. This benefit is now available.

- Set for August, USCIS will be shifting I-140s to their electronic system so they can limit the need to physically transfer files between USCIS offices. Hopefully this helps USCIS become at least a bit more efficient and swift in processing employment-based cases.

- USCIS will implement an online tool allowing applicants can check the status of their very own I-765 (work permit) and I-131 (travel permit) applications (as opposed to checking general processing times).

- Scheduled for October, USCIS intends to roll out new policies and clarifications with respect to H-1Bs, H-2, and I-9, allegedly to help improve the system for applicants. I believe this will involve a re-defining of the H-1B employer-employee relationship, the setting of new guidelines for employer site visits, an elaboration on rules for F-1 students awaiting COS to H-1B, and a clarification on the requirement that an amended or new H-1B petition be filed upon material changes to employment, including a new worksite location.

- USCIS seeks to make self-rescheduling of biometrics available online (clients and attorneys otherwise often face difficulty reaching the USCIS by phone and getting beyond automated prompts).

- Lots of AI tools are becoming available that could potentially bolster our practice and timeliness of service, and it makes sense to explore and utilize them (albeit, not with full and blind reliance).

- DeSantis' campaign politics involve the launch of a future attack on birthright citizenship. Immigrant rights organizations have been alert and hard-working in doing all possible to fight against constitutional abuses.

- We’re still awaiting news regarding the Dignity Act, which, by contrast, may lead to many POSITIVE transformations to the immigration field. It’s a bill that has not yet been passed into law. It’s also very ambitious, so there’s no guarantee of passage, but it’s at least a sign of initiated attempts at resolving the many issues plaguing our immigration system. The above certainly isn’t meant to cover all the valuable insight that the panelists delivered. These are merely some key takeaways that I managed to catch while focusing mostly on the business track sessions.

It was a great pleasure seeing familiar faces, and meeting new colleagues, at the 23rd annual American Immigration Lawyers Association (AILA) national conference last week! I’m happy to have spent some time catching up with others from the AILA South Florida Chapter who made it up to Orlando, and, as usual, learning so many golden bits of advice and best practices from fellow immigration attorneys from across the country.

It's no secret that immigration is one of the most challenging legal fields, particularly on account of its constantly changing regulations; shifting governmental policies (many of which are seemingly clandestine); and logistical bogs which we, as attorneys, must help our clients navigate. The immigration landscape has become increasingly influenced by some politicians’ selfish and bleak opportunism over the years, and the trend is only worsening. This makes it ever more important for those who aid the immigrant community to show up, listen, and collaborate on the many ways in which we can best serve our clients, advance their interests, amplify their voices, and counteract inhumane law and policy.

Immigration lawyers are an empathetic bunch, and left to our own devices, we absorb heavy doses of the stress that each our clients bring through our doors. Despite this, we were never trained (as are psychologists, for example), to buffer this stress for most effective service. That said, I’m grateful to AILA for not only serving as a constant source of knowledge, but also as a source of support and motivation. The organization, and all the great minds that comprise its membership, allow us to stay strong and alert for those who rely on us most.

This year, I look forward to contributing on the AILA South Florida CLE Committee, doing my small part in furtherance of the overall effort to keep the immigration lawyer community up to date. I have no doubt the experience will be an excellent chance to make new connections and continue learning from the best.
