What is a Judment?
A judgment is a final court order entered in a lawsuit. A judgment outlines the court's decision on the claims made in a court case and, if applicable, determines the financial responsibilities of the parties as a matter of law.
A collection case is a case in which a creditor seeks a judicial order, or "judgment", finding a debtor liable for the amount of a debt owed. A legal debt collection case can arise from a number of circumstances, including when a person borrows money using a credit card, personal loan, business loan, car loan, or other type of debt, and fails to pay the amount owed.
If the amount owed remains unpaid, often times the Bank or creditor hires a law firm, like Andreu & Palma, to file a lawsuit against the person who borrowed the money to collect the unpaid balance. If the person being sued does not resolve the case or does not successfully defend against it, the court may enter a judgment in favor of the creditor to whom the debt is owed and against the debtor.
Once a final judgment is entered, a creditor has additional legal remedies to recover the amount of the judgment involuntarily. Common methods for recovering money on a judgment include Bank Levy, Wage Garnishment, or filing a lien against property.
So if a judgment has been entered against you what can you do?
Try to resolve the judgment! Just because a judgment has been issued in a case does not mean that you cannot try to resolve the judgment with the judgment creditor voluntarily.
Often times it is better to try to resolve a judgment voluntarily rather than dealing with the financial mess a judgment can make if left unresolved.
