"Siding with the state in a closely watched case that has kept the cannabis industry in limbo, the Florida Supreme Court on Thursday upheld a 2017 law designed to carry out a constitutional amendment that broadly legalized medical ma*****na. The 2017 law’s requirement that ma*****na operators handle all aspects of the cannabis business involves what is known as vertical integration. The court also rejected arguments that the law’s cap on the number of medical ma*****na licenses that the Florida Department of Health can issue is contrary to the constitutional amendment."

The Florida Supreme Court’s recent adoption of the federal summary judgment standard will bring more order and clarity to litigation, but challenge lawyers who lack federal experience.

Per the Orlando Sentinel:

"Renters facing evictions — and landlords who want their past-due rent — might soon be invited to mediation. The prize if they agree to settle their differences: some of that money approved last month by the federal government to keep renters in their homes. That’s how Broward County plans to distribute much of the $59 million in emergency rental assistance funding that the county received on Wednesday [Jan. 20]. Chief Circuit Judge Jack Tuter and County Administrator Bertha Henry are working out details of the program."

Broward Mayor Steve Geller said landlords and tenants who agree to settle their cases in mediation — with the goal of keeping tenants in their homes — would receive payments for tenants’ past-due rent and possibly assistance for future rents.

“We understand the limitations that were placed on the task force in last year’s legislation,” said FPDA President and 10th Circuit Public Defender Rex Dimmig. “They were given the responsibility of reviewing and making recommendations about the criminal justice code. It’s our position what was really needed was more extensive than that.

“We’re dealing with a more than 20-year-old sentencing scheme and the question is really whether or not…the criminal punishment code is still a viable means of determining sentencing.”

“Under section 57.105(7)’s rule of reciprocity, if a contract provides for attorney’s fees for a party when that party ‘is required to take any action to enforce the contract,’ then attorney’s fees are authorized for the other party if ‘that party prevails in any action. . . with respect to the contract,’” Chief Justice Charles Canady wrote for the court in the credit card ruling. “Here, the fees were authorized for the debtors because both conditions required by the statute were met.”

11th Circuit Chief Judge Bertila Soto has suspended jury trials through January 31, 2021, in order to protect the health and safety of the community and court staff during the COVID-19 pandemic.

This was determined in consideration of the rise in new COVID-19 cases throughout Florida and Miami-Dade County and the upcoming holidays, according to the court.

Only jury trials are affected by this temporary suspension, which will remain in effect through January 31, 2021.
