Be careful how you sign when doing business through an entity. One signature in the wrong place can turn a business obligation into your personal liability. Your LLC or corporation only protects you if the documents are signed properly.

When you co-own a property - whether with a partner, a sibling, or a friend - things can get complicated fast.
Many people assume that paying more means owning more... but that’s not how the law works.
In a partition case, courts often look at contributions, but the key is documentation:
• Mortgage payments
• Taxes & insurance
• Repairs
• Renovations
• Improvements
• Who lived there
• Who maintained the property
Credits may be available, but nothing is automatic - and without records, it’s hard to claim your share.
If you own property with someone and things aren’t equal anymore, getting legal guidance early can make all the difference.

Realtors: make sure your client is working with the right lender. The right lender can make the deal. The wrong lender can kill it.

Does everyone need a trust or a will? Not necessarily. For some people, a Lady Bird Deed may be enough to accomplish their goals. The key is speaking with an attorney to understand which estate planning tools best fit your situation.

What’s the difference between a will and a trust? ⚖️

A will directs how your assets should be distributed after you pass away, but it must go through probate, which is a court process that becomes part of the public record.

A trust, on the other hand, allows your assets to be managed and distributed privately according to the instructions you set. After you pass away, the person you name as trustee follows the terms of the trust and distributes the assets to the beneficiaries, often without going through probate.

Both tools serve important purposes, and the right choice depends on your goals and your specific situation.

Thinking about moving with your child after a court order is in place? ⚖️

In Florida, a parent cannot move more than 50 miles from their current residence with the child if there is an existing court order regarding timesharing or custody. To relocate, the parent must either obtain the other parent’s written consent or receive permission from the court.

This rule exists to protect the child’s relationship with both parents and ensure that any major relocation is in the child’s best interest.

Did you know there’s a way to pass your home to your loved ones without going through probate? In Florida, a Lady Bird Deed allows you to keep full control of your property during your lifetime while ensuring it transfers automatically to your chosen beneficiary when you pass away. It’s one of the simplest and most effective estate planning tools for homeowners.

When should you update your estate plan? ⚖️

Life changes should trigger legal updates. Three major times you should revisit your estate plan are:
• Having a baby – so you can name a guardian and plan for your child’s future.
• Getting married – your spouse should be included in your planning.
• Getting divorced – you may need to remove an ex-spouse from important roles.

Your estate plan should evolve as your life does.
